1. Govt is sending three documents to the EU tonight - the 1st, the Benn Act extension letter, exactly as set out in law, but that PM has not personally signed; 2nd, a cover note from Sir Tim Barrow and the 3rd, a letter signed by the PM arguing that further delay is a mistake
2. Govt lawyers and advice from Attorney General is that Johnson is complying with law as Benn Act forced him only to ask for delay, not to change his policy - belief they can apply the law in this narrow and specific way will enrage critics
3. Court of Session in Edinburgh was already looking at this issue on Monday - expect campaigners there to argue very strongly that govt is trying to circumvent the law in an inappropriate way and frustrate the spirit of the Benn Act
4. So this will be back in court, and easily heading again to Supreme Court, a test of the frustration principle - in other words, is govt breaking the law in practice while applying it in theory ? (expect a lot of chat about Padfield, if you haven't heard about it already)
5. In meantime, govt is determined to push for another vote on its deal asap on Monday, if that's blocked, they'll try again on second reading of the bill that would enact our departure on Tuesday, but it could all get even more messy in Parliament very fast
