If MPs Vote FOR the deal are we Trapped in the EU with a Customs Union?

1) The Letwin intervention on Saturday had the effect of invoking the Benn act requiring the PM to send an extension letter to the EU. But it ALSO REQUIRES additional actions, including that the Political Declaration is changed.
2) The Benn Act Section 1(4) describes this requirement as ‘..including provisions reflecting the outcome of inter-party talks as announced by the Prime Minister on 21 May 2019, and in particular the need for the United Kingdom to secure ...

4) Now this is slightly confusing. The inter-party talks didn’t result in any outcome as such. So, effectively they didn’t result in any further negotiations with the EU or subsequent changes to the Withdrawal Agreement and Political Declaration. So the outcome was no change….
5) And no change means that these ‘provisions’, and changes to the Political Declaration, would mean the ‘deal’ therefore changes back to including a Customs Union - that's what Theresa May had agreed. That was the status in May.
6) Sound odd? Well yes it is but why would this amendment have been tabled in this way months AFTER the inter-party talks had concluded with no agreement? Was it designed to confuse and mis-direct people away from the true purpose?
7) A Brussels based barrister certainly thinks so. And ultimately its the EU who will decide how to interpret this…
8) If MPs vote for the deal thinking its the one that Boris presented last week and this explanation is correct.. they are wrong. They will be voting on a deal which makes the EU part of a Customs Union.

@SteveBarclay Exit/entry declarations are slightly different than customs decs. Before import/export there is a requirement to submit a pre-arrival, pre-departure notification - info that allows authorities to control what's moving across borders from a safety and security perspective.

@SteveBarclay This information is mainly used for risk analysis and not to calculate the amount of duties due or apply other trade policy measures as in the case of customs declarations.
In principle, they are submitted by the carrier not the importer/exporter

MPs face some exceptionally difficult decisions today. There are no easy options: they're weighing up different types of harm, based on uncertain calculations for the future, amidst rising public fury. If I were an MP I'd back the Letwin Amendt & a referendum. Here's why.[THREAD]
1. The case against Johnson's Deal is very strong. It puts us on course for a much harder Brexit than anyone envisaged in 2016. All serious economic projections suggest a substantial hit to GDP, household income and the public finances - and we all know who will bear the brunt.
2. The Deal is being sold on a lie: that it "gets Brexit done". In fact, it simply creates a new cliff edge at the end of 2020, when we will face the whole Deal/No Deal scenario again. If FTA negotiations founder, we'll have until July to request an extension: another cliff edge.

EU leaders not being bloody-minded when insist today that they see an increased likelihood of a no deal #Brexit .. Even if majority of MPs vote against “no deal” today that in itself doesn’t legally stop it from happening. MPs have to unite around another plan first 1
Just extending the Brexit process does not in itself prevent “no deal” from happening at a later date. That’s why EU keeps banging on about Parliament not just agreeing on what it doesn’t want but finally deciding what it does want: the PMs deal/another deal/elections/2nd ref. 2
And that will involve MPs holding their nose and voting (in many cases) for their least worst scenario rather than an ideal which may not realistically find a parliamentary majority or for magical #Brexit solutions that simply don’t exist 3

This is gonna be long, but I think it's worth it. A well-regarded twitter poster, let’s call him Giorgio, has recently publish a thread stating among other things as follows. “The pathways to stopping or delaying Brexit are blocked.
But once the mandate is discharged, the pathways to UK rejoining, or being in a close association agreement with EU, within the single market and customs union, will be open, with no obstacles.”
This approach annoys me for two reasons, one because Giorgio seems to be attempting to cajole Remainers to put all activity on hold until we actually leave the #EU.
