VanDyke is the ninth Trump judicial nominee to be rated "not qualified" by the ABA committee, and the third circuit court nominee to date. He's been nominated for one of the Nevada seats on the 9th Circuit (filling Judge Jay Bybee's seat now that Bybee is taking senior status)
A "not qualified" rating from the ABA committee that vets judicial nominees is rare, both historically and also for this administration — Rs have accused the ABA of bias, but the vast majority of Trump's nominees have been rated "well qualified" or "qualified"

The judge in Oklahoma ruled that a temporary delay of some surgical abortions is allowed under the circumstances, but not to the extent that it prevents women from having the procedure altogether. And the judge said no to the ban on medication abortion.
(Also I realized too late that I saved this document with a URL that misstates the name of the plaintiff — it's South *Wind* Women's Center not South *Bend*! Apologies for any confusion)

SCOTUS won't take up the fight between DC's public transit system (WMATA) and the Archdiocese of Washington over WMATA not allowing religious ads (or political/advocacy ads) — this leaves WMATA's policy in place, for now supremecourt.gov/orders/courtor…
The "for now" in that first tweet is important, because Gorsuch and Thomas indicate they would very much like to take up this issue in the future and reverse. Why not now? Kavanaugh, who was involved in hearing (but not deciding) the case in the DC Circuit, recused.

Senate Republicans are doing untold damage to our federal judiciary by rubber-stamping so many of President Trump’s radical & unqualified judicial nominees. Today, it was Lawrence VanDyke. Here is some of what we know about Mr. VanDyke:
The American Bar Association’s peer review process found Mr. VanDyke “not qualified” and described him as “arrogant, lazy, an ideologue, and lacking in knowledge of the day-to-day practice.” Americans deserve qualified, non-ideological judges with proper temperament.
Emails show that Mr. VanDyke has let the gun lobby shape his litigation decisions. And during his unsuccessful campaign for the Montana Supreme Court, he sought the NRA’s endorsement, saying that gun control laws are “misdirected.” He prejudged the issue.

Andrew Brasher of Alabama, to serve as Circuit Judge on the 11th Circuit. Brasher currently serves as a District Court Judge in Middle Alabama. He graduated from Harvard Law.
John Cronan of New York, to serve as a Judge on the District Court for the Southern District of New York. Cronan currently serves as Principal Deputy Assistant Attorney General for the Criminal Division at DOJ. He graduated from Yale Law.

Surprising to run across these claims by Dahlia Lithwick in a long article for a UK publication. prospectmagazine.co.uk/magazine/how-d…

Contrary to what she suggests, the ABA continues to rate judicial nominees, and Trump's nominees have fared very well. 1/
When I last checked, ABA ratings for Trump appellate nominees were higher than for Obama's. Perhaps that has changed, but it's clear that Lithwick hasn't done a comparison. 2/
Lithwick's suggestion that Trump nominees don't *generally* meet "high standard of legal professionalism" is unfounded. As with any administration, there is always room to criticize some nominees. But they're not representative of the whole. 3/

1/ Several months ago, I first learned about something called the BITE Model, a model of extreme social control. It is an acronym for Behavioral, Information, Thought, and Emotional Control. ABA, as a therapy and a culture, does all of these things.
