After hearing what @joegrogan45, Director of Domestic Policy Council, said last week about @FDATobacco regulating ecigs, it seems he may be interested in a way to split #ecigs and #vaping into a few categories. THREAD
Correct me if I’m wrong, but @FDATobacco could ammend the deeming rule and exempt certain types of products. This would also take a lot of work off their plate. They could exempt components sold separately like e-liquid, atomizers, mods, etc.
Products sold with strict age verification at adult only vape shops and online stores. They could decide to only apply the PMTA to a finished e-cigarette product that is sold all together. For example a prefilled cartridge system that includes an e-liquid, battery, atomizer.
This would also make sense because these types of products are what the overwhelming majority of teens are using according to recent data and while @ScottGottliebMD was at FDA, he hinted at a carve out for these components cause they’re primarily used by adult smokers quitting
As an alternative, there could still be safety and manufacturing standards applied to those components that are not required to go through PMTA. Not sure if FDA could do this or if it would fall under another agency. Look to the UK for examples of this.
This kind of compromise would keep thousands of independent businesses open, benefit public health, and help with the teen use issue. It’s a fair compromise for the vapor industry and something the community would be happy with.
