Dwivedi argues that there are two conflicting judgements of the SC on the issue of Article 370. Both these judgements in the cases of Prem Nath Kaul and Sampat Prakash were delivered by coordinate Benches of Five Judges. Therefore, this case needs to be heard by a larger Bench.

Dwivedi argues that Article 368 could not have been used to repeal Article 370 which granted special status to Jammu and Kashmir.
