What did ya tell you? USCIS is first out of the gate on this #FridayThe13th: building on the DUIs memo USCIS has now revised its Natz policy to "unlawful acts" that *adversely affect* the good moral character inquiry
This is significant not only definitionally but also on how this is already [the trend has been there for the last 18 mos or so] and will continue to impact N-400 and N-336 interviews.
Here is the most troubling part for me: "An act is unlawful if it violates a criminal or civil law of the jurisdiction where it was committed. The provision addressing 'unlawful acts' does not require the applicant to have been charged with or convicted of the offense."
violation of "any civil law"?!? This opens the door for an officer to inquire about ANYTHING. In this era of over-regulation it could be rom disqualification of employee as independent contractor to speeding to committing a tort to not paying a judgment or bill.
officer may make finding that an applicant did not have GMC due to the commission of an unlawful act evidenced through either
* admission,
*conviction, or
*other relevant, reliable evidence in the record, meaning data offered by BigTech ... the potential for abuse is boundless
Sorry, forgot to include the link to the memo ...
