—sentencing of Feb 27 hearing CANCELLED until @GenFlynn claims of ineffective assistance of counsel are fully litigated

—DOJ/Flynn team to meet and discuss waiver of prior attorney/client privilege between Covington/Flynn
Next update is a status report from the government by Feb 20, possibly followed by a joint update from the DOJ/Flynn - or if not, Flynn motion to oppose waiver of attorney/client privilege by Feb 24
Oh and just for @ProfMJCleveland, Sullivan let Powell get away with filing 50 mins late last time and considered that “timely filed” 👍🏻

Imagine if DOJ had investigated McCabe for two years & at the end of it declined to charge him criminally but still wrote a report detailing all the bad things he’d ever said, done or thought about doing & then claimed the report “does not exonerate” him & hinted he be impeached
Then imagine that the “crime” he was being investigated for never even happened, was largely based on a fake dossier funded by his political opponents and McCabe’s attempts to clear his name were then claimed as evidence of “obstruction” despite being legally incoherent
Boy that’d sure be a “disgrace”. Can’t have that. Sounds very politicized

Yet that’s what McCabe helped to do to Trump and many in his orbit

If Durham delivers nothing given him taking a victory lap on this expect the anger to be volcanic

@SidneyPowell1 knew exactly that the DOJ would seek to obtain @GenFlynn attorney-client comms with his prior firm, Covington. ABA opinion states “the filing of an ineffective assistance of counsel claim does not act as an unfettered waiver of all privileged comms”. Only the comms
that are relevant to the specific areas in which @GenFlynn is claiming prior counsel failed him would be subject to disclosure; the issue is that his prior counsel was grossly ineffective and the ineffective assistance claim seems to span the entire timeframe of representation

They need to speak w/ Flynn's former lawyers once the Court orders the atty/client waiver.

Flynn cooperated but Trump doesn't call him a "rat." He even wishes him "Good Luck" in court. Also tweets he's worried about what Flynn has to say re "Russian Collusion." What's Trump gonna say now that Flynn delayed sentencing to cooperate some more & Judge brings up treason??

Every single 1 of the 'Brady law progeny' the judge refers to - that are explained in the {1} footnote, has to do with the PROSECUTION WITHHOLDING EXCULPATORY EVIDENCE FROM THE DEFENDANT BEFORE A GUILTY PLEA WAS ENTERED.
