This individual had the means to post a bond. Research shows that when cash is the primary determinant on who gets in and out of jail, it doesn’t make us safer. Decisions should be guided by effectively assessing “risk” and research. With money involved, too many folks that may
not be a high risk, sit in jail, while high risk offenders can pay their way out of jail. This is why we should move to an “intentional system of detention”; we currently do not have that. Nobody wants any defendant to be released pretrial only to further their criminal careers
while we are trying them for any particular charge. In a model bail system, based on intentionality, such a person would likely be held without bail period. But when we look at the details, we see that it is not so easy simply because TX is currently in-between systems. I
support the #txlege widening the net at the top allowing more serious offenders to be held without bail (rich or poor). We can also be more intentional in advocating for the proper release of individuals on the lower-risk side of the equation. Moreover, there is a clear need
to improve the gps ankle monitor system both locally and statewide. And, we can strengthen the bond revocation process. The caveat being that due process must be maintained; possible instances where that’s overlooked. In the end, if evidence supports conviction, offenders need to
be held strongly accountable. Most discussion surrounding bail focuses on the pre-trial side of a criminal case. I’ve learned quite a bit in running one of the largest jail systems in the country. We all should have an interest in procedural justice and a speedy process for all;
defendants and crime victims alike. I get a daily look at inefficiency and ineffectiveness. If the basis of our system is innocent until proven guilty, why does anyone have to wait 2-3 weeks to see their home judge? I’ve also called out the lack of visits by “some” court
appointed attorneys. People, do your jobs! Justice delayed is justice denied: for victims, defendants, and taxpayers. We can do better than this. #HouNews #lesm
