Now online (apparently leaked) - full text of the EU proposal for the draft future relationship treaty with the UK: drive.google.com/file/d/1_Q7mEE…
The draft EU proposal for a future relationship treaty with the UK is a massive beast, but here's some very selective excerpts and comments
The basics of the EU/UK partnership. This agreement will apply to many issues, but any separate treaties will in effect be attached to it. The Commission has proposed a separate foreign policy treaty (not public AFAIK). The UK is not interested in negotiating that issue though.
Rules of interpretation: international law (unsurprising), EU law when referred to (not that common), WTO case law. Private companies/individuals can't invoke the treaty as such. Withdrawal agreement is reaffirmed.
Level playing field, State aid: the UK must apply EU law (a red line for the UK). Possible to add new EU law in this field. Discussion in the event that a new law isn't added.
More on State aid law. UK authorities (not Commission) would apply it. But national courts in the UK would have to refer cases to CJEU potentially. Another red line for the UK.
On the other hand, the level playing field provisions on competition don't refer to EU law, and dispute settlement wouldn't apply except for the requirement to have an enforcement body.
Level playing field, taxation. No dispute settlement on the first Article, but it would apply to the second Article: non-regression on tax avoidance and the exchange of information.
Level playing field, labour law. Non-regression, and no exclusion of dispute settlement. The EU would be asking for more than it asks from other non-EU countries, including the UK in the first withdrawal agreement. Ditto environmental law, except for climate change...
On climate change, there would be a different dispute settlement process involving an expert panel, although some of the usual rules on remedies etc for breach of the treaty (not in the screenshot) would still apply.
Free trade in goods: abolition of customs duties. Also many details on customs cooperation, rules of origin, technical and health standards.
Fisheries: access to waters and annual negotiations on fishing opportunities
UK government reacts to the proposed text on fishing
Services: free trade but with exclusions for long term migration, transport (which is covered by other parts of the draft), and audiovisual services.
Mobility: visa waiver for short term visits (already in EU law). Might still be visa requirement for paid activity. Longer stays for students etc but only in accordance with each side's law. Detailed protocol on social security coordination. Waffle on cross border maintenance etc
Security cooperation: details on various replacements re aspects of data exchange, extradition, exchange of evidence etc. Remember UK wants this to be a separate treaty.
Extradition: similar to the European Arrest Warrant, but with various exceptions, such as the option to check for dual criminality in more cases (the EAW law bans such checks for this list of crimes)
The EU suggests many provisions on money laundering, although the UK has not shown an explicit interest in this yet. Launch the conspiracy theories!
Details of the UK participation in EU programmes. Will it apply to Horizon, Erasmus, etc? We are referred to a protocol, so let's dash to see...>
Oh.
Governing the future relationship treaty: there will be a Partnership Council with lots of sub committees parliamentary cooperation etc. The usual thing.
Dispute settlement: arbitration process similar to the withdrawal agreement. It will have to ask CJEU to interpret EU law disputes. Note that the draft only refers to EU law in some places, and that dispute settlement is switched off in some cases.
Reminder: the CJEU says that the EU cannot sign up to treaties that let arbitrators interpret EU law, rather than the CJEU. For the UK to achieve its red lines here, it has to remove references to EU law, or at least make sure they are not subject to dispute settlement.
Final provisions: the treaty wouldn't apply to Gibraltar or the other remaining pink bits, and it's separate from the withdrawal agreement (although dispute settlement would be linked, ie breach of the withdrawal agreement could lead to retaliation under this treaty).
Good question. The EU draft proposal for a treaty with the UK makes no mention of unaccompanied child asylum seekers, or any other asylum issue. The EU (other than the European parliament) has never shown an interest in negotiating on this.
There's nothing in the draft EU proposal for a future relationship treaty with the UK about the status of UK/EU citizens currently in the EU/UK. The withdrawal agreement would still apply.
