New judgment in controversial European Arrest Warrant case: Spanish EAW issued for rapper convicted of "glorification of terrorism" due to song lyrics referring to violence will be harder to execute in Belgium.

2/ Background: the rapper left Spain for Belgium after the conviction due to his song lyrics. First instance court refused to execute the warrant. After this press story, prosecutors appealed and the appeal court asked CJEU to interpret the EAW law. bbc.com/news/world-eur…
3/ Extradition is usually subject to a "dual criminality" test: ie the alleged offence must be a crime in both jurisdictions. This is one of the arguments of the Assange defence; the counter argument is that the UK has abolished this test in domestic law.

There will be different sets of negotiations, meeting frequently
2/4 Sending negotiation documents between the parties (and public transparency)
3/4 Eleven negotiation groups for the EU/UK talks, and dates for the first five negotiation rounds.

Note no group to negotiate on foreign policy issues, because the UK position is that foreign policy cooperation with the EU should not be subject to a formal agreement.

1/ Here's a summary of my latest blog post, comparing the UK and EU positions on negotiating the future relationship on justice and home affairs.
2/ It's often suggested that CJEU jurisdiction is a big difficulty in these talks. But the EU has signed treaties in this field with other non-EU countries without demanding CJEU jurisdiction. It has found other ways to protect its (legitimate) interests instead.

WTO rules allow "compulsory licensing" but with conditions.

If the govt considers that the patent-owner is selling too expensively, or is failing to supply the medicine at all. What it can do is to force the patent-owner to license someone else to produce generic versions.

But under WTO rules, compulsory licensing requires certain conditions.

1. Normally the government has to have negotiated a voluntary licence first. If that fails a compulsory licence is possible.

2. In an emergency, negotiating a voluntary licence can be skipped.

3. In any case the company owning the patent has to be paid for the licence, it has to receive adequate remuneration. The WTO's rules don't say how much. It's left up to the country's (UK's) law.

New Thread About Norman Davies 2 Volume History of Poland: God’s Playground, a source recommended to me by nearly every book I’ve checked out about Russian history concerning Poland or the Baltic Crusader histories of William Urban.
To start off, here is Davies philosophy of history and the state of Polish English language scholarship circa 1979.

Interestingly he notices the Communist government takes the old nationalist school (obscuring population transfers) and talks about “American parallels” in decline
The book opens with the genesis of preserved polish sources. What’s interesting is that both style and form were in flux, while the chronicle was more thoroughly established in Rus’ both as a undisputed form of history and as a city imperative.

It all started last year with Ukraine’s new education law requiring more Ukrainian language education for minorities who previously had much bigger autonomy. This ‘reform’ is a tool of Ukrainian nation-building&was primarily aimed at restricting Russian language education.
Collateral damage occurred as Polish, Romanian&Hungarian minorities were affected as well. Poland&Romania managed to solve the situation with Ukraine through negotiations but Hungary went berserk instead. Here’s a very good summary in English by @OSW_eng:
