1. Day 2. Julian #Assange #ExtraditionHearing #UKHighCourtOfJustice.I'll report on it. In this extradition proceeding, the #USDoJ acts through the @CPSUK, challenging psychiatric evidence used by the judge Baraitser to deny extradition. There's an important info you have to know.
2.#CrownProsecutionService(#CPS) putting in question Julian #Assange's mental health: don't forget #CPS contributed to create the legal& diplomatic quagmire which kept #Assange arbitrarily detained 9 years and finally resulted in his arrest. This is how they looked at #JA's health
3. what I am trying to tell you is: when the Crown Prosecution Service (#CPS) tries to argue that the Julian #Assange's health is not in such a bad shape, hence he can be extradited, just consider how #CPS looked at his health. This is an official document from my #FOIA
4. note: you are free to use my #FOIA document on how #CPS looked at Julian #Assange's health, please just mention it comes from my #FOIA litigation, which has required 6 years of hard work and it is still ongoing!
5. glad that finally many journalists are covering the hearing: today we have #WallStreetJournal. The times they are changing: this case will decide the future of journalism and not only that: the freedom of the public to be informed about war crimes, torture,State criminality
6. Fitzgerald (JA's counsel): the test is: there is *sufficient risk* of him committing suicide to make the extradition "oppressive"
7. Fitzgerald (JA's counsel): it's legitimate for the court to address the future deterioration of JA's conditions in US detention (Note:yesterday the #CrownProsecutionService' counsel=#US counsel, Lewis, argued 'prediction of future' was not to rely on)
8. Fitzgerald (JA's counsel): if a person's condition is such that whatever steps are taken by the requesting state, the person would commit suicide driven by his mental disorder, then extradition is oppressive. The mere fact that there are measures in place is NOT enough
9. Fitzgerald (JA's counsel): if there is a *high risk* he would commit suicide if extradition, this meets the test that extradition would be oppressive (hence should be denied, as judge Baraitser did)
10. NOTE: today Julian #Assange is NOT attending /watching the extradition hearing. Yesterday, when he appeared briefly, I was shocked to see how dangerously thin and very unwell he was
11. Fitzgerald mentions surveillance in the embassy and #CIA plans to kill and kidnap Julian #Assange, recently revealed by @Isikoff @zachsdorfman and colleagues at @YahooNews
12. in a nutshell: Fitzgerald (JA's counsel) argument is: if whatever measures are taken, JA would be driven to commit suicide by his mental disorder, that would make extradition "oppressive" (hence it should be denied, as judge Baraitser did)
13. Fitzgerald (JA's counsel): even if you can prevent the risk of suicide temporarily, you cannot prevent it in the long term
14. when following this JA's extradition hearing, you understand how crucial the #LauriLove case
15. Fitzgerald: Mr.#Assange repeatedly told Dr. Blackwood (#CPS's medical expert assigned to assess JA's mental health) that he had two children with #StellaMoris, hence nothing was kept hidden, as #CPS claims in order to question Prof.Kopelman's impartiality
16. to help you to understand:Lewis(#CPS's counsel=#US counsel) has repeatedly tried to undermine Prof.Kopelman's medical evidence on JA by arguing that, in his first assessment, Prof.Kopelman omitted to reveal @StellaMoris1 was JA's partner and had two children
17. now Fitzgerald(JA's counsel) tells us that JA had told Dr. Blackwood(#CPS's medical expert assessing JA's mental health) that he and @StellaMoris1 had two children: nothing was kept hidden
18. Fitzgerald(JA's counsel) is now telling the court why @StellaMoris1 was concerned about her safety and privacy:her concerns should be seen in the context of the heavy surveillance in the embassy by #UCGlobal + attempts to poison/kidnap him, as revealed by Yahoo!
19. important: Fitzgerald (JA's counsel) says that it was NOT Julian #Assange who told Prof.Kopelman to omit the fact that he has a romantic relationship with @StellaMoris1 and had children. It was Kopelman's ethical decision
20.don't understand the importance of the fact that,in his 1st assessment,Prof.Kopelman did NOT refer to Moris-JA relationship and their kids? #CPS'counsel=#US counsel,Lewis, has widely used this fact to undermine Kopelman's impartiality in his mental health assessment of JA
21.Fitzgerald mentions how judge Baraitser found that Prof. Kopelman omitting JA-Moris relationship was "understandable" and NOT undermining his scientific impartiality while assessing JA's mental health
22. Fitzgerald (JA's counsel): Prof. Kopelman omitting JA-Moris relationship in his 1st psychiatric assessment was NOT done in cahoots with Julian #Assange or StellaMoris, it was done to protect vulnerable persons.
23. Fitzgerald: trying to depict Prof. Kopelman's decision to omit JA-Moris relationship in his initial assessment as lack of impartiality is a MISERABLE attempt [by #CPS counsel] to undermine the reputation of an eminent psychiatrist
24.Fitzgerald explains how hugely qualified Dr @sondracrosby16 , a prominent US expert on torture and Post Traumatic Stress Disorder
25. NOTE: @sondracrosby16 is well-known for her work with Peace Nobel recipient, @P4HR, on torture, on asylum seekers, on #Guantanamo
26. Fitzgerald tells how bad that the #CPS counsel, James Lewis, tried to attack Dr @sondracrosby16's impartiality and qualifications
27. Fitzgerald (JA's counsel): #CPS cannot relitigate "risk of suicide" which made judge Baraitser ruling that extradition would be oppressive
28. Fitzgerald:contrary to what #CPS'counsel tried to argue, Dr.Fazel did NOT disagree with Dr. Deeley on his diagnosis of JA suffering Autistic Spectrum Disorder(ASD).Fazel just argued he agreed on ASD, though he was NOT an expert on it. So NO disagreement between psychiatrists
29. Lunch break. Hearing restart at 2 PM London-time
30. hearing restarts after lunch break. TODAY 3 PM NY-time join our panel moderated by @ryangrim with @kgosztola @ChipGibbons89 and me:
31. and tomorrow, don't miss the legendary @rogerwaters in conversation with me and @progintl:
32. make sure you book your place for our conversation with the legendary @rogerwaters on the Julian #Assange case, democracy and imperialism. Book it now for TOMORROW, thanks to @ProgIntl:
33. Fitzgerald (JA's defence) quotes from #UCGlobal's internal emails in which #UCGlobal's boss, David Morales, discusses targeting @StellaMoris1
, hence her concerns about her safety and privacy. Note: #UCGlobal's emails are at the center of a criminal investigation in Madrid
34. Mark Summers(JA's defence):the US response was NOT: there is no risk of exposure to SAM, Kromberg(US DoJ attorney): SAM is possible.SAM=Special Administrative Measure=prison regime characterised by the alleged #Vault7's source as "being treated like an animal"
35. more accurate: Kromberg= Assistant US Attorney
36. Mark Summers (JA's counsel) now refers to the Yahoo! investigation by @Isikoff,@zachsdorfman and other colleagues on #CIA planning to kill/kidnap JA and other #WikiLeaks journalists to show the lenght the #CIA agents were prepared to go
37. NOTE: #Vault7 was published by #WikiLeaks in partnership with us, the media partners. Personally, I published 15 articles on my then newspaper,@repubblica, based on the #Vault7 files: so far, no info on targeting of media partners by the #CIA has surfaced
38.Mark Summers(JA's counsel) referred to #Vault7 to argue how the #CIA might use such publication of secret #CIA files to call for SAMs in order to keep JA under heavy isolation(SAM is justified as a measure to prevent the dissemination of classified info)
39.Mark Summers(JA's counsel):in a Spanish case,Spanish court asked the Spanish government to take all possible steps to deal with the violation of assurances provided by the US in an extradition case
40. in a nutshell: in the case of extradition to the US from Spain,US provided diplomatic assurances the extradited person would serve his sentence in Spain, but the US did NOT comply and the Spanish court asked the Spanish government to take all steps to deal with such violation
41. the Spanish case Mark Summers (JA's defence) refers to is the Mendoza case: the wording of the diplomatic assurances provided by the US in this case did give US an easy way around the diplomatic assurances provided to the Spanish court
42. the #CPS counsel=#US counsel, James Lewis, is now arguing that the detention of JA under #SAMs and at #ADX are "speculative"
43. it's becoming beyond absurd: #CPS' cousel, James Lewis characterises the suicide risk as "suicide ideology"= abstract risk
44. #CPS'counsel, James Lewis, back to his obsession again: destroying the credibility of prominent psychiatrist, Prof. Kopelman, who assessed JA's suicide risk
45. #CPS's counsel, James Lewis, back to his tactics: arguing that the psychiatrists, Prof.Kopelman,Dr. Deeley, Dr. Fazel who assessed JA's mental health had significant disagreements
46. hearing is out
47. apologies, hearing is not out
48. hearing is now out!
49. for those asking: unclear when the court will issue its judgement. very likely to take months
50. I feel the duty not to be silent:it doesn't matter all this is legal, they are literally killing Julian #Assange. I was shocked to see how unwell he is
51.IMPORTANT:in my live-tweeting about the #Assange extradition hearing at the UK #HighCourtofJustice I tweeted that Prof.Fazel did assess JA mental health for the JA's defence. It's wrong: he did it for the prosecution(US).I apologise for this.Accuracy is really important to me
