⚡️ Pls RT! A question we've gotten: Are there limits on speech for Nazi white supremacists in America? Let's review... /1
(As always, this thread will be stored in our pinned Thread Library, where you can find our past discussions) /2
Courts have assumed that the most imp kind of speech is political speech & the most endangered speech is the most controversial speech. /3
SCOTUS has said that the law can't specifically ban Nazis from marching through a Jewish neighborhood /4 aclu.org/other/aclu-his…
SCOTUS has said (in RAV vs. St. Paul) that the law can't specifically ban cross burning /5 oyez.org/cases/1991/90-…
However, Virginia v. Black limited RAV and allowed states to criminalize burning a cross with *intent to intimidate*. /6
SCOTUS has said that cities can't ban a radical anti-LGBT Church from protesting funerals /7 👉🏽 oyez.org/cases/2010/09-…
So...in short, lawmakers can't tailor laws to limit the speech rights of a particular group. /8
So that's what the First Amendment means when it says Congress and the states can "make no law respecting the freedom of speech". /9
Addendum: /10
The law largely protects controversial speech. i.e. The law protects you from prosecution for having and speaking certain views.../11
The law does NOT protect you from other non-prosecutorial consequences. eg employers can fire you for espousing views seen as abhorrent. /12
Family can shun you. Dogs can stop waggin. Your FB friends may give you a "WTF?". These are not infringements on your free speech. /13
