Sullivan, a Montgomery, AL city official, filed a libel action against the NYT for the ad. Won a $500k judgment for fact errors in ad. /3
SCOTUS said the 1st Amdt protects the press' publication of all statements, even false ones, in about the conduct of public officials/4
All statements about public officials (even false) = free speech unless made with "actual malice" and "reckless disregard for the truth"/5
