Special Counsel known as Special Prosecutor or Independent Counsel is a 4th branch of government. SCOTUS in Morrison v. Olson 1988, shockingly rules it constitutional. However Justice Antonin Scalia gave a SCATHING dissent which was originally a 30 PAGE draft. #DEMANDRosenstein

Justice Antonin Scalia, in the audio of the opinion called the Constitution "structure was to prevent EXCESSIVE governmental power which is always the first THREAT to liberty from coalescing" or in other words the legislative/judicial branches CANNOT become the EXECUTIVE BRANCH.

Article 2 Section 1 of the Constitution sustains that the executive POWER shall be vested in a President of the United States. Justice Antonin Scalia in Morrison v. Olson 1988 said "Placing this power in someone else has first of all an intimidating effect upon his advisers."

Special Counsel hijacks the power of POTUS. Justice Scalia says "Taking away prosecutorial discretion hurts the President. Nothing is so effective for that purpose as being able to say that X number of the President's close associates are under investigation or indictment."

Mueller as Special Counsel is given power from Ethics in Government Act of 1978 connected with Administrative Procedure Act of 1946 created the Code of Federal Regulations which Attorney General writes/enforces 28 CFR 600 General Powers of the Special Counsel. #DEMANDRosenstein

Also in Title 5 of USC gives Mueller the ability to function as the Attorney General. Title 5 of USC is known as Government Organization & Employees sections 509, 510 & 515. Rosenstein cites these sections in his original ORDER appointing Mueller. #DEMANDRosenstein

28 United States Code is DISTINCT from 28 Code of Federal Regulations. United States Code known as USC becomes law as Congress authors it. Code of Federal Regulations known as CFR is shaped by Administrative Procedure Act. Attorney General makes ALL rules/regulations for DOJ.

Putting this into perspective the Attorney General has POWER to make rules or regulations. Administrative Procedure Act of 1946 defines Department of Justice as: authority of government with ability of rule making, agency process for formulation, amendment or repeal of a rule.

Coincidentally, 28 CFR 45.2 states no DOJ employee shall participate in a criminal investigation or prosecution due to conflicts of interest. Rosenstein has a substantial connection to Mueller because Rosenstein was hired by Mueller in 1990 out of law school. #DEMANDRosenstein

Ethics in Government Act of 1978 was written by Democrat Senator Abraham A. Ribicoff as a result of the Nixon Watergate case dating back to 1972 to 1977. Administrative Procedure Act of 1946 was written by Democrat Senator Pat McCarran as a result of the New Deal by FDR.

Ironically, Ethics in Government Act of 1978 became law on October 26, 1978. FISA Act of 1978 became law on October 25, 1978. Inspector General Act of 1978 became law October 12th 1978. Civil Service Reform Act of 1978 became law on October 13, 1978. #DEMANDRosenstein
