I've been asked to send @educationgovuk an email with my questions about the #baselinetest. Here's a thread of the questions I've asked so far.
1. Will parental consent be requested to test the children and to gather and store the data, given the fact that they will not be of compulsory school age?
2. If parental consent is not requested, why is this being assumed in the absence of specific consent being given to process the data? On what 'lawful basis' will the data be gathered?
3. How will the data be stored and will the data link to each individual child?
4. If the data is not linked to individual children, how will the progress measure work when there are changes to the cohort between Year R and Year 6?
5. If the data is linked to an individual child, what rights of access and erasure will their parents have to the data?
6. Where will the data be stored and how can parents be reassured that it will be stored safely?
7. Who will handle the data and who will act as the data controller? Will this be NFER or the DfE?
8. Who will administer the test and, if this is the class teacher, what arrangements will be made for the rest of the class while the teacher is absent? Will schools be required to buy in qualified teacher supply cover or do you anticipate them using support staff?
9. If a child leaves the English school system, how will parents be able to ensure that their data is removed from the systems?
10. How will you take into account a variance of up to 25% in age of the children in a Reception class, and the impact this will have on their test results?
Suspect they are wishing I would just shut up and go away.

Thanks to people for suggestions, I've sent some a few additional questions (see below). I bet the DfE are wishing they'd never asked.
11. Which third parties if any will have access to the children's data?
12. How long will the results and personal data be retained?
13. How will parents know who has used their child's record and for what purposes?
14. How will children be able to access their data at age 18 and ensure that it is erased?
15. How will you ensure that the test does not discriminate against forces children, who change schools regularly?
16. How will you ensure that the test does not discriminate against children from travelling families and any other groups who are regularly mobile between schools?
17. What will happen in the case of an adopted child if the data is linked to an individual and their name is changed on adoption?
I'll stop there, but there are lots of other questions still to be answered. And I bet they're wishing that I hadn't just read up on GDPR for preschool. 😂/ends
