i’ve got a few minutes before things get started in the ramos trial today, so here are some scattered highlights from my notes from goodwin’s trial yesterday.

elmer repeatedly returned to the idea that harris was “safe” at any point during the assault or could have stopped it by simply curling up in a ball. both he & his client said many times, “he just kept getting up.”

over an hour into his cross examination yesterday morning elmer said to harris “you’re safe here,” referring to a still from the video of the assault.
harris reacted strongly, “i’ve already been hit! i’ve been maced! i’m not perfectly fine there!”

in the afternoon, w/ jury not present, elmer said “he coulda stayed right there curled up in a little ball. but he didn’t do that.”
judge moore, to his credit, said incredulously, “you really believe that?”
elmer: “he woulda been safer.”
judge: “he would’ve been a sitting duck.”

judge, to elmer: “you’re not really arguing that the safe thing for him to do is to just lay there in the parking garage.”
but that was his argument. he argued that all day. his own client said he was trying to “neutralize him.” that he “just kept getting back up.”

elmer in closing: “if someone attacks you, they’re probably gonna do it again. you’ve got to stop them to make sure they don’t do it again.”

he problem is deandre never attacked goodwin. goodwin was never in danger from deandre harris. and goodwin kicked an unarmed, prone man who was being assaulted be a crowd.
more on yesterday later. this morning’s slow jury selection gave me time to pick through those notes a bit more & they are... upsetting.
