1/ Reading through the executive order on family detention that @realDonaldTrump signed, there's another fight brewing, again related to the Flores Settlement but in reverse.
2/ Flores was brought as a class-action suit against the government and immigration officials because human-rights advocates didn't like how detained children were being treated. It took 12 years to settle (1985 to 1997).
3/ Part of that treatment was the LENGTH of detention. The courts said, with the Flores agreement, that the government couldn't hold kids for longer than 20 days....
4/ And yet... the EO Trump just signed calls on the attorney general to file a request in federal court to "modify" Flores "to detain alien families together throughout the pendency of criminal proceedings..." because of "present resource constraints."
5/ In other words, because Flores currently requires that kids be released after 20 days, the Trump admin wants the court to change it to be able to detain them essentially indefinitely because there aren’t enough immigration judges to get cases through quickly.
6/ This was part of the criticism with the Obama administration when it set up family detention centers. Trump official on call with reporters, per @HorsleyScott says it's on the judge whether families will be able to be detained together or not
7/7 Expect Trump admin court filing not to be the only one...
