3/ What about "qualified immunity"? It protects "officials from liability for civil damages insofar as their conduct does not violate clearly established statutory or constitutional rights of which a reasonable person would have known." These rights are clearly established.
4/ The lawyers in the Travel Ban case should file letter with the Supreme Court asking them to take notice of racial animus and flagrant constitutional rights violations in border family separations, as well. Animus drives this entire administration.
