with all due respect to @tunkuv, he's been misled here. The reason why the Polish govt wants to take over the courts is political: They want to make sure they don't lose the next elections. Nothing to do with fighting "communism" wsj.com/articles/if-am…
repeated analyses have shown that the average Polish judge was less than 13 when the Berlin wall fell; that there are only 8 senior (Supreme Court) judges out of 100 who were on the bench during martial law, 6 of them heard criminal (non-political) cases
nobody disputes the need for reform of Polish court system, mostly because it is very slow, but also nobody believes that court-packing will fix the problem. The constitutional court, which has already been packed, is now politicized and far less effective that before
As I've written before: the only point of sacking all judges over age 65 is a power grab. It gives the ruling party control of a court that certifies elections. Nothing more, nothing less. Nothing to do with immigration, Euroscepticism, Europe's cultural values.
Finally: the most prominent, influential former communist, a man actually responsible for prosecuting dissidents, is a Law and Justice MP, Stanislaw Piotrowicz. If the Polish govt really wanted to fight remaining communists, they would sack him.
instead, he's the prominent spokesman for...judicial reform. No wonder other Europeans believe this Polish government seeks the return of a communist-style one-party state.
