Just in: Joint motion from DOJ and ACLU asking the judge in family separation class action (Ms. L) to make clear a parent has two options — stay with their kid in detention and waive the kid's release rights under Flores, or waive right to reunification assets.documentcloud.org/documents/4599…
Basically, making clear that the Ms. L reunification order and the Flores agreement, when read together, don't mean that a *parent* has any new right to release. This was discussed at the last hearing: buzzfeed.com/zoetillman/the…
Latest status hearing before Judge Sabraw in the Ms. L is about to start, stay tuned for updates
Long hearing this afternoon in the family reunifications class action (Ms. L case). Here's what went down:
1. Later today, DOJ is going to submit its plan for how the government will go about reuniting families going forward. Judge's deadline for reunifying kids 5-17 is July 26
2. On issue of verifying an adult is a parent, judge made clear that the government should use "common sense" — doesn't need to be DNA testing, can be documents or other means that can satisfy the government. DOJ lawyer said they are not requiring parents to pay for DNA testing
3. DOJ lawyer said the difficulty in making lists of parents and kids eligible for reunification is that it requires ICE and HHS operators to sit down and "marry" their information into a master list
4. ACLU says they just learned about a child whose father by adoption who was denied reunification despite having adoption papers — still trying to figure out that situation
5. Govt plans to start reunifying families on a rolling basis, with those reunifications happening at a small number of facilities, which they say will make it easier to keep track of. Judge ordered 12-hour notice before reunifications
6. ACLU said it was worried mass removals would start taking place over the weekend once reunifications began, before parents could decide if they want kid to stay and pursue asylum. DOJ lawyer said she didn't have info on that. Judge said ACLU could file if that became an issue
7. Judge set a series of dates for status reports and hearings leading up to the July 26 deadline. Next hearing will be Monday. That's all for now (unless I realize I've missed something significant later on)
NEW: DOJ filed info about its reunification plans going forward in the family separation case (Ms. L). Estimates ~2,551 kids are potentially eligible for reunification, argues the judge has ordered "truncated" vetting that could pose risks to kids assets.documentcloud.org/documents/4599…
