In a Christmas Eve memo, 1998, Brett Kavanaugh argues that a sitting President cannot be indicted, but a subsequent President and AG can indict a former President. archives.gov/files/research…
Actually, from this memo alone, it's unclear whether Kavanaugh is arguing a President *can't* vs *shouldn't* be indicted. It says it's their recommendation in this case that indictment be deferred to the next President/AG.
.@chrisgeidner found something interesting. Really interesting.
Much less interesting: travel receipts from Kavanaugh's stay at the La Quinta Motor Inn West in Little Rock for $48/night during his Starr work. Not exactly living the dream, coming out of a Supreme Court clerkship.
