This is INSANE!!
Rick Scott is trying to RAM through 3 conservative Supreme Court justice picks BEFORE his term ends & AFTER they are forced to retire because of a mandatory age 70 limit—a window that could be only hrs. All 3 justices have opposed Scott in major cases.
👨‍⚖️👩‍⚖️👩‍⚖️All three justices: Fred Lewis, Barbara Pariente & Peggy Quince are scheduled to leave on January 8, 2019—Scott says midnight.

💣Scott's term ends the exact same day, but he believes his term officially ends the next day (1/9/19) at noon when the new Governor is sworn in.
🛑There's an intermediary step: the Supreme Court Judicial Nominating Committee (JNC) is supposed to come up with a list of replacement candidates for the three justices for the 7-member court before the decision is made.

🚅So Scott ordered the commission to start in mid-Sept!
👩🗳️The League of Women Voters has filed a lawsuit to stop this process "to allow nominations before the vacancies occur would allow the JNC to infringe on the new governor's right to take up to 60 days to make the decision."
✅Perhaps to help Scott set some sort of precedent, Appellate Judge Robert Foster resigned four days before his mandatory retirement date ▶️and Scott cancelled the election in order to name his own judge, but ▶️his opponent David Trotti filed a lawsuit in Florida Supreme Court.
👨‍⚖️👩‍⚖️👩‍⚖️And Scott has imposed a November 10th deadline for the JNC—another effort to speed up the more than questionable process—and yet another reason the League of Women voters is contesting in their lawsuit.
😨Using the 60-day period a Governor has to make his decision, this "interpretation of the deadline falls on the 2nd day of the new Governor's term. This is the ultimate last possible day the appointments can be made.

⚖️So the League of Women Voters is challenging Scott's premature starting of the 60-day clock, first.

👨‍⚖️👨‍⚖️👨‍⚖️Complicating the matter, the new governor might be limited to the choices made by Scott's JNC if Scott's plan stays in play.
ℹ️RE: Attorney David Trotti: Ironically, the #Florida Supreme Court will make the final decision on this case. A lower court said the Governor did not have the right to cancel the election, but an appeals court reversed that decision. So, higher court.

⁉️This case may or may not affect the Supreme Court appointments.

🔥But the League of Women Voters—and likely some other parties—will probably file more lawsuits to stop Rick Scott from changing #Florida's highest court.
💥#RedTideRick tried something like this before when he tried to change the number of Supreme Court justices—and the way it is structured—to favor conservatives.
