The DOJ opinion on the Whitaker appointment is SPOT ON. #NeverTrumpers are either are playing dumb, or they are ignorant re: the extent of the Executive Branch's authority, the legal precedent in support of THE Whitaker appointment, and basic constitutional law.
They can't demand that Whitaker recuse when Rosenstein has actual, serious Russia conflicts. And remember - they defended top intel officials Page, McCabe, Comey, Strzok, Ohr , etc. for having blatant political bias because they could be "trusted" to do their jobs w/out bias 🙄

A controversy emerged today between @SethAbramson and @emptywheel about the implications of Mueller’s Status Report filing in United States v. Manafort.
Emptywheel is surely right that Mueller must have anticipated (or at least considered) that Manafort would continue to lie even after the plea agreement. The lying probably means that Paulie is hoping for a pardon. I also agree with her analysis of the motive behind the filing.

I think I caught a major legal error on p. 5 of the OLC memo on #Whitaker.
OLC argues that the Vacancies Act applies to DOJ statute 28 USC 508, because the DOJ statute cross-refers to the VRA.
That would be difficult b/c Congress passed 28 USC 508 before the VRA. See my thread:
This is the part of the memo with the error. This DOJ statute (28 USC 508) was passed and amended in the 1940s, 50s, 60s, 70s, 80s. No later changes. The 3345 reference pre-dated the VRA.
VRA passed in 1998.
It would be impossible for the DOJ statute to “cross-reference” the VRA.
