BREAKING: #SCOTUS vacates the 11th Circuit's stay of execution in Domineque Ray's case. Justices Ginsburg, Breyer, Sotomayor, and Kagan dissent. The court also denied a related stay of execution. The case is out of Alabama.
Here is the full dissent: documentcloud.org/documents/5732… / If not the first, this is, at least, one of the rare times when Justice Kagan has written the dissent in a death penalty case.

JUST IN: Maria Butina and government prosecutors agree that Butina is not yet ready for sentencing because "[t]he defendant’s cooperation is not yet complete." Continuance until Feb. 26 requested.

Thursday's #SCOTUS stay in the LA abortion case was already (likely) the _fourth_ time in three months that Chief Justice Roberts broke from his conservative colleagues and joined the more progressive Justices on a stay application.

A short #thread on why this is worth watching:
The first two were on the same day, November 2, 2018.

In the census litigation, the Court denied the Justice Department's application for a stay over noted dissents from Justices Thomas, Alito, and Gorsuch:

And in the Juliana climate change case, the Court also denied an application for a stay from the Solicitor General, this time with Justices Thomas and Gorsuch noting that they would have granted the application:

This is an outrage. #SCOTUS just reversed an Eleventh Circuit decision blocking an execution where the inmate, a Muslim, wanted an imam rather than a Christian chaplain to accompany him in the execution chamber. Justice Kagan dissents, "I think that decision profoundly wrong."
Kagan writes: “'The clearest command of the Establishment Clause ... is that one religious denomination cannot be officially preferred over another.' Larson v. Valente, 456 U. S. 228, 244 (1982). But the State’s policy does just that."
Kagan: "A Christian prisoner may have a minister of his own faith accompany him into the execution chamber to say his last rites. But if an inmate practices a different religion—whether Islam, Judaism, or any other—he may not die with a minister of his own faith by his side."

SCOTUS did not rule that baker’s refusal to bake cake for same sex couple was constitutional. Court ruled the CO Human Rts Commn tribunal that ruled against the baker in MASTERPIECE CAKESHOP was not neutral but hostile to the claim. Baker was entitled to impartial decisionmaker.
It’s a narrow ruling.
It’s fair to say the Court ruled “for the baker,” but not in the way that phrase implies. Perhaps more accurate, the Court struck down the decision of the CO Human Rts Commission b/c a majority of justices believe the baker did not receive a fair hearing.

Great job this morning by @NateWessler, arguing in the Supreme Court to make sure we don’t have to sacrifice our privacy to use new technology.

A few thoughts on the argument:
Chief Justice Roberts may have set himself up to extend his Riley decision to cellular location data. Justice Alito argued many times that Carpenter is indistinguishable from Smith and Miller. 1/
Alito seemed unpersuaded that location data is any more sensitive than the call records from Smith. And he speculated that many people understand they volunteer their location data to the telecoms. Justice Kennedy said the same. 2/
