Whitaker will be called to appear in the coming days at which point he will be compelled to clearly designate whether he is claiming executive privilege.
I should say, Nadler didn’t specifically say subpoena, but made it clear that Whitaker will be called back to provide written deposition and specifically declare whether or not he will be declaring exec privilege, and that anything else was unacceptable.
