Barr weighed in & cleared Trump of obstruction after 48 hours’ review, when Mueller declined to make a judgment, in essence, leaving it to Congress to do so.
Barr’s letter is careful to say he does not believe there is proof, beyond a reasonable doubt, of acts of obstruction with a nexus to an official investigation & corrupt intent. That is how he couches his obstruction finding & it leaves a lot of gray area Congress should explore.
Barr has taken an expansive view of executive power. We don’t know based on the letter, but it would be consistent with his view for him to conclude that, for instance, firing Comey, which he was “entitled” to do, couldn’t be an act of obstruction.
The question that jumps out is, why Mueller didn’t make a decision on obstruction? That’s a prosecutor’s job. Did he decide to leave it up to Congress? Was he prevented from making a decision? It’s hard to imagine Mueller shirking, even, especially, if it was a tough call.
