1/ J. Gorsuch in Bucklew: "the Eighth Amendment is the supreme law of the land." It is refreshing to see a Justice say that the text of the Constitution itself, and not a precedent interpreting that text is the "supreme law of the land" Cf. Breyer joshblackman.com/blog/2015/12/1… #SCOTUS
2/ J. Gorsuch accuses J. Breyer's principle dissent of "clip[ping]" the quotation (taking it out of context.) I'll keep that phrase in mind for the future.
3/ J. Gorsuch also sheds some light on the recent stay issue in Dunn v. Ray. J. Breyer replies in turn, as did J. Sotomayor, which refers to "today's belated explanation."
4/ J. Breyer's dissent takes the unorthodox step of responding to J. Thomas's originalist concurrence--usually CT is ignored. CT replies in turn.
5/ Typo in J. Sotomayor's Bucklew dissent? She refers to Part IV of J. Breyer's dissent. (There is no part IV.) She didn't join Part III. cc: @howappealing #SCOTUS
6/ J. Sotomayor also refers to "federalism and finality" as "little more than our own policy impulses."
7/ The typo in the Sotomayor opinion has already been fixed
