Hello on this lovely spring morning from the federal courthouse, where Roger Stone is appearing for a status hearing at 11am. He's wearing a gray suit, light blue and white striped shirt, navy tie with white/light dots, and a white pocket square. Asked how he's doing: "Good"
Mueller's office is winding down, but there are still two attorneys from the special counsel's office at the table for Stone's hearing, Aaron Zelinsky and Adam Jed, in addition to lawyers from the US attorney's office in DC
Roger Stone's status hearing is underway, US District Judge Amy Berman Jackson is on the bench
There are no discovery issues at the moment, but there is still disagreement over whether Roger Stone and his lawyers should be able to certain redacted portions of Mueller's report that relate to his case — Stone's lawyer says the redacted version isn't sufficient
AUSA Jonathan Kravis says the redacted portions at issue relate to "mental impressions" and conclusions of government attorneys that isn't subject to disclosure, but they have been producing evidence gathered by the special counsel's office that relates to Stone's case
Kravis says normally govt memos/analysis aren't subject to discovery in a criminal case. Jackson asks if the situation is different now that Mueller has made hundreds of pages of analysis public, and whether he's opened the door. Kravis says they don't think the standard changes
Basically, what the government is arguing is that they're making all the underlying materials available to Stone re: evidence about him and evidence that relates to the credibility of witnesses, but the top-level analysis/conclusions of that evidence by Mueller isn't discoverable
Kravis says Stone's lawyers are getting grand jury testimony from the government's anticipated trial witnesses as well as any civilian witnesses who testified about anything related to Stone's case
Jackson indicates she's less open to giving Stone *all* of the redacted portions of the Mueller report, as opposed to the sections that specifically relate to Stone, but will wait for briefing to make a decision
And that's a wrap. A short, uneventful hearing for Roger Stone today. There are a number of motions pending, and hearings on those are already scheduled for May 30 and June 21 (and his trial is still set for Nov. 5)
An addendum to today's Roger Stone hearing: AUSA Jonathan Kravis introduced all the lawyers for the govt as being from the DC US atty's office, incl. special counsel office lawyers Aaron Zelinsky and Adam Jed. The US atty's office confirms they're working there as special AUSAs
