Some of the reaction to this decision seems overblown. It’s not at all a decision on the merits as p2 makes clear. “At this early pleadings stage of the litigation,we do not assess the merits of the plaintiffs’ antitrust claims against Apple,nor do we consider any other defenses”
That’s particularly so because both the majority and the dissent referenced pretty severe class certification and damages problems. Majority at 9-10 even suggested the possibility that “the consumers’ damages would presumably be zero.” And the dissent at 5-6 picked up those its
