Just in: DOJ instructs Robert Mueller not to go beyond the public report in testimony Wednesday, reminding the former special counsel (and Dem lawmakers?) that Justice doesn’t talk about uncharged 3rd parties. Also points out gag orders in two ongoing cases: Roger Stone & Concord
DOJ adds another note of caution: it says matters within the scope of the Mueller probe were covered by a variety of privileges that would include “decisions about investigative steps or decisions about your investigation not otherwise covered in your public report.”
Translation: dial back your expectations some more for Mueller’s five + hours of testimony this week.
Mueller has already told us he doesn’t want to testify and that his report is his testimony. I read this letter from DOJ as giving him another way to set boundaries on Weds and the letter says Mueller asked for guidance July 10 about privilege and “other legal bars” to testimony.
