I add a personal note. I started as a Government lawyer and have spent over 20 years in private practice doing public law, often representing the Government.
I have always felt that it is a huge strength of our constitution that Government (of all parties) respects the law, and does not just go through the motions. It generally behaves properly in litigation, and engages independent lawyers to advise it and to represent it in court.
But if Ministers start treating complying with the law as merely something they “will look at”, and feel free to tear up the understandings on which the rule of law and accountability to Parliament depend in this country, we are in deep trouble.
