The question now is whether the seller was eligible (legal) to sell. Also why did the murderer fail his previous background check if his criminal record doesn’t list any prohibitions? Legal private sales are sales that also pass BGCs.
Additionally, legal private sales are not shown to contribute to homicide w illegally possessed firearms, however studies indicated black market (illegal private) sales responsible bjs.gov/content/pub/pd…
Remember: A criminal act is NOT a loophole.
Another Q — and hopefully we will get answers on this soon — if the murderer was denied via his previous background check, why? If a falsified 4473, why was he not arrested and charged?
Sad fact: Nothing usually ever happens to people who are denied purchase via a failed background check (falsifications, prohibited possessor, etc) politifact.com/new-hampshire/…
And studies have shown that those denied obviously go on to commit other crimes cnn.com/2018/12/21/us/…
…. Biden once said that "we simply don’t have the time or manpower to prosecute everybody who lies on a form [4473]”

Which is why the question of WHY this murderer failed his background check needs to be answered.
