Bercow ruling that Queen's Consent is not required for the Benn bill.
This is important. Removes one of primary hopes of the government to block it.
To be clear Queen's Consent and Royal Assent are different things:

Queen's Consent: more esoteric, required when it's deemed legislation affects the royal preogative. Is occasionally denied.

Royal Assent: royal authorisation given at end of legislative process. Never denied.
If Johnson tries to deny Royal Assent (not done since the reign of Queen Anne) it would be unprecedented in the democratic era (indeed, before the democratic era) and unconstitutional. Oh and probably destroy the monarchy.

The election is being deferred because the anti no dealers, suddenly and unexpectedly working together harmoniously, now have a stable parliamentary majority to do with as they like. Cummings’ expulsion of Tories has solidified it. It suits them to keep the govt trapped.
Democratically, constitutionally that is pretty questionable. But it’s happened because of his own constitutional indiscretion, his hurriedness to prorogue. Without that, none of this would have happened. The premiership he for so long coveted, is for now, a perfect prison.
Cummings, the alleged great mastermind, forgot that other people can act unpredictably too.

I’ve covered some big Brexit nights this year but this feels the biggest since May’s deal first went down. it’s marked the end of one Tory party. For decades it’s tolerated both sides of the Europe civil war. No longer. The Brexiters are in complete control. It’s their party now.
No longer a broad church, the Tory Party is now a narrower sect. Theresa May never adopted such draconian policies because fundamentally she cared about it, it was dear to her. I’m not sure the same can be said for Boris Johnson and Dominic Cummings.
The cost of their being purer is being smaller.

It would be odd, to say the least, for Johnson’s opponents to have spent two months lambasting him as an unelected prime minister, accusing him of launching a coup and then when he asks for for an election, refusing to grant it.
There are plenty of MPs who are rejecting an election completely and just trying to secure another extension and see what happens when we get there. Johnson is right about something: extensions like that are becoming increasingly futile.
If an election is guaranteed on October 14th and legislature cannot tolerate govt policy (and won’t replace it with another) it would be constitutionally proper to have an election.

Emerging from lunch in Bxl. So it seems November election likely after all opposition parties agree to delay approving contest until Article 50 extension has been approved at 17-18 European Council. How will @BorisJohnson now honour his pledge not to seek extension? 1/3
Several options under consideration, including: asking Queen not to give Royal Assent to extension Bill; refusing to implement it; asking another EU member state to veto extension; attaching conditions (eg will disrupt EU) that would make EU more reluctant/deny extension or 2/3
passing no-confidence vote in own Govt in hope that leads to election. None of them good options 3/3

This is a truly extraordinary article, in which John Finnis advocates proroguing Parliament until after 12 April, in order to 'terminate parliamentary debate' on Brexit.

Finnis goes on to argue that this would be 'wholly legitimate as a matter of constitutional principle' and would be 'in the interests of good government' and the 'responsible conduct of our international relations'. /2
Finnis seeks to justify this argument by reference to the referendum, to which he appears to attach such paramount importance as to warrant the deliberate termination of parliamentary debate. /3

This is a thread about Bills sent to the President by NASS, for assent. Recall that just yesterday PMB declined assent to five Bills. With reasons, of course, per usual.

We have a problem, people, and I’ll explain why. Hopefully the 9th NASS (incoming) can help.
The reasons for the withholding of Presidential Assent tend to be similar. I’ll highlight the common ones:

One is that a good number of these bills tend to be rent-seeking in nature. They seek to carve out a special ‘Fund’ for the exclusive benefit of an Agency.
So, 1% here, 2% there, 0.5% there, too many Bills have clauses that are designed to corner some money. 1% of total tax paid on the Oxygen in the atmosphere, for an Oxgyen Development Fund that will be managed by the Nigerian Atmospheric Management Commission. You get the drift.
