Indeed. Marbury v Madison (SCOTUS) is about courts intervening to stop the legislature infringing the constitution (in the judges' view). Cherry/Miller is about the courts intervening to stop the *executive* limiting the scrutiny/control it faces from the legislature.
A closer parallel with Marbury v Madison would be litigation to require the PM to request an extension of EU membership under the Benn-Burt Act, in which the govt argued that the court should strike down the Act as invalid.
In Marbury v Madison, SCOTUS defended the power to strike down legislation because the judges believed that the legislation conflicted with the US Constitution: a "higher law" type of constitution that most States have. But constitutional law in the UK takes a different form.

If the UK doesn't leave the EU then #Brexit becomes a permanent embedded feature of our politics that will occupy the national debate so that we never move on. Uncertainty becomes the norm and investment bleeds away. Politics will be ugly and dangerous like never before.
Brexit kept our politics off balance for three decades. Its the burning issue that wont go away without resolution. If we're saying that votes are only observed when convenient to the establishment then the UK ceases to be a democracy at which point civil society norms fall apart
Politicians speak of the need to restore trust and civility in politics but if they dont deliver then there's zero chance of that. The contract is broken. None of them have a right to expect civility when they've appointed themselves rulers over us. As for trust, fuhgeddaboudit!

Here's a tldr THREAD
The story centres around a power couple in Brexit politics, Matthew and Sarah Elliott. Matthew was chief of Vote Leave and still has fingers in lots of Brexit pies. Sarah is chair of Republicans overseas, and used to work for fossil fuel magnates the Koch brothers.
In the US, the couple have strong ties to the #Kochtopus network and libertarian Trump-funder Robert Mercer. In the UK, they have strong ties to the remnants of the Leave campaign, and a network of groups lobbying for mass deregulation post-Brexit based out of #TuftonStreet

This analysis, by my former boss @CER_Grant, is sound as far as it goes...but in my view omits a few very important factors...1/ of a thread on aspects Charles couldn't possibly fit into a short op-ed (and I try not make too long a thread out of it :-).
2/ As many Irish and other EU commentators have long noted, Charles - who is rightly widely read and respected across the EU - seems to have long suggested that the other EU26 may not back Ireland in a final treaty crunch. In a straight geo-politics game he might be right, but...
3/...this has annoyed a few people because it goes to the heart of what the EU is, especially for Ireland. If the EU does not back Ireland on such an existential question - and yes folks, #Brexit is existential - then why should Ireland stay in the EU? Or any other small member?

Let's examine one of the key points, where Owen advises Lord Adonis to resign his peerage and campaign for remain & also election
3) by this we must assume Owen advises all progressive peers resign their peerage (like Tony Benn) and look for proper election whilst campaigning for Remain.
