Companies are within their legal rights to advocate for their positions, participate in rulemakings, and challenge executive agency decisions in court to ensure APA procedures are followed and constitutional rights protected, among other things. This is the United States. 1/8
These businesses should not be chastised or mocked by their representatives, including the USSG, for asserting those rights. 2/8
Also, why do you assume companies are NOT trying to comply with premarket review, just because they may also be challenging or “lobbying” for better rules? I maintain that many are. 3/8
But PMTAs are enormously complicated. Never before have companies ever had to prove a population-wide benefit. This is arguably higher than the “safe and effective” standard for drugs. 4/8
Not to mention constantly shifting goal lines. The final PMTA guidance was just published in June, and a new proposed rule just last week! This is me working through it instead of focusing on my @dallascowboys on #sundaynightfootball. 5/8
The vast majority of small vapor businesses that make up the back bone of the industry are not opposed to regulation and product review procedures that make sense AND protect vulnerable populations, primarily youth. 6/8
But we need more time. We were working toward 2022, then 2021, then May 2020 (virtually impossible for most), and now potentially, no compliance period at all for non-tobacco flavors. All because a particular company’s product went viral among some teens and THC drug dealers. 7/8
All we ask is for some fairness in this process. We can all agree #NoEcigs4kids but #HarmReductionForAdults. End rant. 8/8
