A few interesting things in the @GenFlynn motion by DOJ opposing production of Brady material.

The wording on this raises an issue that I have discussed several times but now adds to the timeline. Immediately prior to Gen. Flynn's guilty plea on 11/30/17, DOJ provided his defense counsel (it doesn't say the defendant) with exculpatory evidence including the 302.

What defense lawyer would walk their client into a guilty plea immediately after being told that the FBI agents involved had both testified that they thought he was innocent of lying?
And being handed a 302 from those agents saying that he did lie?

This makes it look like Flynn's original defense counsel were targets of a sting, if they withheld that evidence from their client (looks like they did) & then had him plead guilty, we have a major issue coming to a head with the response to this pleading.

Remember the timeline:
11/29/17 McCabe interviewed by OIG for the final chance to come clean.
11/30/17 Flynn's attorney's given evidence that showed their client was probably innocent.
11/30/17 Attorney's have Flynn plead guilty.
12/1/17 Judge Contreras accepts guilty plea.

12/2/17 First Strzok/Page texts are released
12/2/17 DOJ OIG announces an investigating into Strzok & Page & their potential misconduct in the MYE & Russia investigations.
12/4-6/17 Judge recused.
12/5/17 Bruce Ohr demoted
12/7/17 Judge Sullivan assigned the Flynn case.

How long until we hear that General Flynn's lawyers advised him he had to confess to the judge, even if he wasn't guilty because it was the only way to get such a good plea deal...

It happens every day in our 2 tiered justice system.

But we now know from his partner's verdicts being thrown out on appeal, that these FARA violations were false too. That the law wasn't violated, & that the same law firm Covington & Burling given exculpatory evidence on 11/30/17 also filed the 'false' FARA documents.

Now the DOJ filing also discusses additional Brady disclosures. Prior to the original 12/18/18 Flynn sentencing hearing his defense lawyers were given ALL of the Strzok-Page texts including ones that are not public.
Ones they are under investigation for!

You don't think there might be some exculpatory texts in there that they should have shared with their client?
Some about falsifying the "F 302" that is the basis for the false statements charge, maybe?

Would be a very big deal if DOJ did comply with Brady & his lawyers hid it!

The Mueller team states that they conducted an investigation of the "F Flynn" comments allegedly made by McCabe, saying they couldn't find any evidence it actually happened including the 2nd agent denying it.

But we know someone started an FBI leak investigation about those comments, before they were published. Why would the FBI conduct a leak investigation about something that didn't happen?

So is DOJ relying upon false statements by FBI agents Strzok & Pientka that they did not conduct misconduct against Flynn in this case? That won't help if they are accused of doing exactly the things they lied to federal agents about!

Now DOJ claims that Flynn knew about the Strzok exculpatory evidence on 11/30/17, when they only claimed above that they had provided it to his defense lawyers. It may normally be safe to assume providing it to counsel is adequate to inform the defense, but not in this case...

There is no way that exculpatory evidence only provided on the same day as the plea on 11/30/17 was thoroughly reviewed for information helpful to the defense prior to his guilty plea that same day.

I wonder if his attorney's warned him against having an independent court advocate review the Brady evidence to ensure that @GenFlynn wasn't being railroaded by his own attorneys. That isn't something that gets offered often by a judge. Almost like he suspected in December 2018.

If his attorney's knew about additional Brady evidence that was not turned over (@SidneyPowell1 has a huge list) & they lied to the judge at his first sentencing hearing, there will be hell to pay!

@SidneyPowell1 This looks like 330 unclassified pages from DIA provided to Flynn's counsel.
