Looking through new #Brexit deal, the preamble has lost some of the paragraphs in the previous #WithdrawalAgreement from April 2019 👇
Here's the addition in the preamble to the Protocol on Ireland/Northern Ireland in the new #Brexit #WithdrawalAgreement that refers to democratic consent from NI for application of EU law. 👇
What might be a very important deletion of wording from what was in the preamble of the April 2019 version of the #Brexit #WithdrawalAgreement in relation to North-South cooperation, avoiding a hard border, physical infrastructure, checks and controls. 👇
The latest version of preamble to the Protocol on Ireland/Northern Ireland in the #Brexit #WithdrawalAgreement no longer contains the words "any future arrangements must be compatible with these overarching requirements".
The new #Brexit #WithdrawalAgreement has lost paragraph 4 of Article 1 from the April 2019 version. 👇
Article 2 (Subsequent Agreement) and Article 3 (Extension of the Transition Period) that were in the April 2019 version of the Ireland/Northern Ireland Protocol in #Brexit #WithdrawalAgreement have been deleted from today's version. 👇
Articles 5 (Customs, movement of goods), 6 (Protection of the UK internal market), 7 (Technical regulations, assessments, registrations, certificates, approvals and authorisations), and 8 (VAT and excise), appear to set out complex arrangements, signalling flexibility from EU.
Article 10 (Agriculture and environment) that was in the Protocol on Ireland/Northern Ireland in the April 2019 #Brexit #WithdrawalAgreement has been deleted from today's version. 👇
Article 18 in the Protocol on Ireland/Northern Ireland of the new #Brexit #WithdrawalAgreement is the one on democratic consent of NI for continuation of arrangements in the Protocol. The UK Gov has issued a Unilateral Declaration on Consent (here: bit.ly/2VYXdtL).
@CCBSCrossBorder will consider issuing statement on today’s #Brexit #WithdrawalAgreement pending views expressed by @HouseofCommons .

Effectively -despite all the noise - the state of #Brexit negotiations has NOT really changed in last three days or so:
i) Much as there is huge political will in EU to get Brexit deal done.. /1
EU leaders do NOT want to be hurried into making a new deal to fit Boris Johnson’s timetable. Has to be something they can live with - that doesn’t cause potential probs for single market/ NIreland peace process in years to come /2
ii) This is very difficult to ‘fudge’! EU demanding not ‘good intentions’ as to how single market and peace process should be safeguarded on island of Ireland after Brexit but rather a ‘legally operative text’ /3

In the media frenzy of “Will there/won’t there be a new #Brexit deal this week?” things are likely to become clearer on Wednesday .. the eve of the EU leaders summit. In the meantime there’s lots of smoke, mirrors and second-guessing going on /1
Some in EU I’ve spoken to comment on how ‘upbeat’ key player Ireland seems to be. Which should, logically be an indication that a new deal is on track, right? Except others in the EU question Dublin’s motives: upbeat for real or to avoid being labelled the Nay-sayers, they ask /2
European Commission assures that the negotiations are being carried out in good faith on both sides. Clearly there’s political will to get this deal done once and for all. Little appetite for endless extensions on either side BUT /3

After meeting the PM, Irish Taoiseach Leo Varadkar says: a new #Brexit deal is still possible this month. Now up to Commission. Hopes negotiations can restart. Said it’s not about which side makes concessions. It’s about getting a deal done so UK can leave EU on 31 October.. /1
So does this mean the two men came suddenly came to a compromise solution behind closed doors? Varadkar said they’d agreed not to talk about the details (in public, one assumes) ? /2
Or, to put a more cynical hat on: is the Irish PM - who was all smiles while making his statement- determined to push back at the bogeyman image the Johnson government have bestowed on him: ‘a naysayer, waiting for new extension, hoping for second referendum/far softer Brexit’ /3

As EU watches open-mouthed the scenes in Westminster.. in Paris, Berlin, Dublin, Brussels and the rest - leaders are asking: What Next?? And since no one knows for sure, there’s some contingency planning going on /1
Chances of getting a deal with UK by the EU leaders’ mid Oct summit were never seen here to be high. Now contacts describe the likelihood as « pretty much nil ». Remember EU governments would need to see the text of a legally operable alternative to the backstop b4 the summit /2
So as to present it to their own governments before approving it. Right now the two sides are nowhere near agreement. EU doubts the PM willing at this stage to make big compromises and EU doesn’t see point in making big sacrifices right now because /3

So. Tomorrow the House of Commons will vote on a series of possible amendments to Theresa May's 'Plan B' - or rather the 'plan of action to achieve a Plan B' - which itself officially reads as follows:
The amendment most likely to pass – and therefore the one on which most attention has been paid – is this one from Conservative party chairman Sir Graham Brady. It's effectively an instruction to go back and seek *some unstated other way* to avoid a hard border in Ireland:
Tonight, Theresa May has asked her backbenchers to vote in favour of this amendment. She is basically asking them to tie her hands, so that Brussels will clearly know what it would take to win the Commons' backing for any deal.
