Dear was charged for murder at the state level in 2015, but was deemed incompetent to stand trial at the time, and was committed to a mental hospital.
Colorado has the death penalty, however this happened in March 2019:

This case is going to get as Horseshoe-ified, because it touches on three lightning rods in the “culture wars”: the abortion debate, the death penalty, & if the mentally ill can/should face trial for their crimes.
