For people discussing the Maya Forstater case I highly recommend reading the actual judgment which is linked in the first tweet in the below thread. Much commentary pretty confused
I do think the judgment may be overturned on appeal because the judge muddled belief and manifestation of belief. But I may be wrong. I think this case has a long way to go, perhaps with a further hearing before the employment tribunal. This was just a preliminary issues
From my perspective, some of the discussion of this case has, ironically (perhaps aptly?), demonstrated the “absolutism” the judge was clearly worried about. I am glad that this court process is an opportunity to consider it through a human rights lens, and a balance of rights
Plainly the right to free speech is engaged as is the right not to be discriminated against or harassed for being trans. The right question is how to protect both, not for one to overcome or ‘win’ against the other
The thing which worries me isn’t robust debate - it’s hostility. I don’t see how dignity (the touchstone of human rights protections) can be protected in such a hostile environment. I also think that was the judge’s deep concern, though he may have overstepped in his solution
