Some rare tidings of comfort and/or joy! Proud to share that my law partner @NicoleMicheroni won (despite ICE's best efforts) a tough asylum case in court yesterday & that a single mother & her young children will be celebrating this #Christmas as asylees.

@NicoleMicheroni ICE's main argument in a hearing held within 48 hours of #Christmas was (among other things) that our client was not eligible for asylum because the unspeakable persecution and trauma that she had suffered had not been inflicted for the "right" reason

An ICE attorney argued today that it was a "close call" whether an Army soldier serving in Afghanistan would suffer hardship if his mother were deported to Central America while he was deployed.

(I'm used to this kind of thing by now, but thought you might want to hear about it)
Not my case, but happy to report it ended with a win!

However, the judge was also of the opinion that the mother's case was a "close call." She had no criminal record & had dedicated her life to raising a man now willing to risk his life for the country now trying to deport her
N.B.: there *was* a special program available to protect members of military families who might otherwise be deported, but Trump loves our troops so much that he has effectively ended it

Conditions are getting worse in the other New England ICE detention facilities since the Suffolk (Boston) jail stopped housing detainees. Rather than being more selective about who they detain after losing the bed space, they seem to be packing them in tighter.

This is not only bad not only as a basic human rights issue, but in terms of how much and for how long detainees are willing to fight their cases. People with many years here and strong ties to the U.S. are being pushed to give up and accept deportation--sometimes permanently.
"Every day in here feels like a year," more than one person has told me. Few people in ICE custody have ever done any time before, & the extra stress of not knowing if/when their cases might resolve (let alone how) can be a near- constant state of mental and emotional torture

Top Myths About #Asylum and why you should care:

Myth: Asylum seekers should file at US consulates in their home countries.

Reality: Asylum can only be sought at the border or inside the US. US consulates do not accept asylum applications.
Myth: Asylum seekers must present themselves at a port of entry.

Reality: The law (8 USC 1158) specifically says a person may apply for asylum whether they enter legally or not.

They can be technically prosecuted for unlawful entry, but that doesn't prevent asylum.
Myth: Asylum is only for political persecution, not for fear of gangs and terrorists.

Reality: There is NO requirement in the law that an asylum seeker's fear be politically based.

I've won many gang and terrorist related cases.

As a fmr immigration attorney let me be unambiguously clear. Crossing a boarder to claim asylum is *not* a crime; no under US or international law. Any child separated from a parent under that pretext is done so in direct contravention to the laws of the USA. ⚖ THREAD Pls RT.
If you came to the US without permission to apply for asylum, youmetjod of entry, whether legal or illegal *should* in no way effect your application process. Illegal entry is not a ground of inadmissibility for asylum applicants.
Unlike many other categories of applicants for immigration benefits, ppl seeking asylum in the US are not barred by having made an illegal entry; for example, sneaked across the U.S. border or overstaying a valid visa (one of the top ways people are in the country illegall).

NIGHT COURT: About to stand on case where my 19 year old client & his girlfriend were jumped by 4 people all older than them. My client has bruises & a stab wound. But he’s charged w/ assault. The reason: the people who jumped him called the cops first. It really is that simple.
This is so common. Even when then there is so much evidence to the contrary. For instance, the people who jumped my client came to his building. They had no visible injuries. The police didn’t even ask my client what happened. It honestly feels crazy at times.
Police often make decisions as to who to arrest in assault cases based on very random factors rather than careful consideration of the evidence. For instance, when one person has an order of protection, they will arrest the other.
