Wish to bring this issue and appeal for your support and advise in the interest of justice and in the interest of devotees or Lord Siva ( Thiruvenkattappan) Vadakkanthara, Palakkad, Kerala

Lord Thiruvenkattappan Siva temple is one of the oldest temple in the region and is visited by thousands of devotees each year.

It is the belief of the devotees that the temple has Rishyasringa prathista and is one of the temples which follows unique ' vidhi ' in comparison to other temples at various agraharams in the region.

The temple also has a pond and Naga Prathista in the vicinity.

The land (Chuttuvazhi - malayalam)surrounding the pond and pond belongs to Lord Thiruvenkattappan

The Hon’ble Munsiff of Palakkad Shri A A Vijayan in order passed under OS No 572/86 on November 17 1990 held that:

a.The temple pond and adjacent land belongs to Lord Thiruvenkapppan temple.
b.The temple shall have all rights to use the pathway and construct any building etc.

Since any closure of entrances to the temple pond might cause issues to the people living the vicinity of the pond, the trustees and people in the village chose to leave the entrance open to facilitate conveyance.

For nearly thirty years i.e from 1990 to 2020 people on either side have used this service for transportation, for procession of elephants during festivals, for two wheeler transportation till January 2020.

One fine morning without seeking permission of Devaswom Commissoner or consulting with all trustees some miscreants have encroached on the land belonging to Lord Thiruvenkatappan for construction of concrete road without any permission from authorities despite protest.

The sound advise of Police to restrain from carrying out any construction activities without proper permission was completely discarded. Host of counsellors with scant disregard to law and moral principles chose to state ' We will do what we set out for and encroached the land'

Since construction of road would make access to pond infeasible, the Managing trustee of the temple had approached the Assistant Commissioner of Malabar Devaswom Board, Palakkad seeking permission to renovate steps to temple pond on December 30 2019.

Based on the representation, The Assistant Commissioner vide letter dated January 03 2020 accorded his permission to renovate the steps to the temple pond. A copy of the permission granted by Assistant Commissioner attached below.

Despite having the permissions and rights over the property as pronounced in OS 572/86, efforts to renovate steps to temple pond located adjacent to Vadakkanthara village was stopped by certain people through coercion and resorting to vandalism and violence.

The Managing trustee of the temple Shri. Arunachalam also has lodged a complaint about the incident with The Police Inspector, Police Station North on January 07 2020 under Petition No 3886/2020. A copy of the receipt is attached below.

Since no action was initiated an online complaint was also filed with DPO, Palakkad with following requests:

a)Direct authorities in providing security and preside over renovation of steps to temple pond as directed by Assistant Commissioner.

b) Initiate legal action against miscreants who stopped the construction of steps to temple pond.

c)ensure that complete right, possession and usage of property located around temple pond in Tharamarakulam, Vadakkanthara is handed over back to the temple authorities.

Under the guise of public convenience, we suspect that private needs are being addressed. Construction of a house by relative of counselor has suddenly triggered the need for this construction which was never an issue earlier !!

Repeated follow ups and representations did not yield any response as such we are reaching out to #Dharmic people on Twitter , for support/ guidance on what ensuing steps should be taken .
