Wow. Super smart filing with @CMAgovUK gets to the heart of the rigged digital marketplace by focusing on intersection of antitrust and data policy. Calls on strong GDPR enforcement of purpose limitations. brave.com/wp-content/upl…
The filing rightly draws parallels to the critically important German Federal Cartel Office decision against Facebook which also addressed sales issues of massive behemoths bundling consent. Facebook ceo Zuckerberg adding Facebook’s brand to Instagram won’t solve it. 🏃 from law.
“Preliminary analysis conducted by Brave indicates that Google has several hundred processing purposes that are conflated in a vast, internal data free-for-all. This is an infringement of Article 5(1)b, in addition to other GDPR principles.”
“The CMA makes similar observations about the combination and cross-use of personal data collected from disparate lines of business, including integrations with websites, apps, and operating systems, to advantage the vertically integrated platforms’ advertising businesses.”
Bottom-line: when lobbies attack EU GDPR as strengthening Google and Facebook, it’s critical to note the law isn’t issue but the need for proper enforcement. GDPR, with enforcement of purpose limitations, improves privacy, reduces disinfo, reduces fraud, fosters competition.
