Roe does not have any actual textual basis in the Constitution, Blackmun based it on "penumbras" meaning he used reasoning on general themes used in the constitution
This means there was never any proof for this newfound right to privacy & abortion
Justice Ruth Bader Ginsburg was a frequent critic of Roe,
she said that it would have been better if Roe had been built upon the equal protection clause of the 14th Amendment, instead of the invisible words found in the penumbras
head of an independent branch, meant to be unaffected by the vagaries of popular opinion
got stuck in deciding so many political cases like Obergefell, Sebelius, or Bush v. Gore this is how we got there #politics@libsoftiktok@stillgray
Chief Justice Rehnquist warned:
“Once the Court starts looking to the currents of public opinion regarding a particular judgment, it enters a truly bottomless pit from which there is simply no extracting itself.”🤔 #roevwade#SupremeCourt@neontaster@nickgillespie@heckyessica
in the Constitution, all rights not referred to specifically are by right, an issue belonging to the states
Abortion, under federalism is supposed to be a debatable issue
Roe v Wade was always in trouble cuz as a political decision it meant that whenever the political winds changed & popular opinions shifted it meant Roe was going to be in danger of being overturned😲
All the serious people, in law, media, universities, & politicians, have long understood Roe was incredibly fragile.
Only thing protecting it was their incessant threats & Stare De Crisis -meaning the court's hesitancy to overturn historical precedence.
@jacobsullum lays out how removing Roe will only lead to a minor reduction in abortions,
Most abortions are becoming pill-driven telemedicine anyways & most will be able to travel to another state where it is legal reason.com/2022/05/03/the…@reason
What might change, is a reduction in the use of late-term abortions,
a large portion of reporting is just trying to get contact info, there are databases, but they are hit or miss, #journalism
TBF with the media's record I understand why people abhor all journos everywhere, but honestly, there are a lot of us that do really want to do the right thing with our stories & sources
I've screwed up & made mistakes,
but never intentionally & I don't plan to change that
there is a sort of wilful ignorance that's popular right now,
you see it in pieces where they talk about a story but don't link to it
Well that extends to some writers as well, thinking that audiences couldn't handle the full context lest it undermine their argument
So under that premise, the Florida Legislature let Disney have independent autonomy under the
Reedy Creek Improvement Zone
Where Disney would be its own county gov, run its own police, fire, sanitation, etc without any of that messy local political oversight #disney#florida
