May be hard for my friends on the left to hear this,

our whole lives we've been told how important Roe v Wade was in giving women the right to abortion via a right to privacy

But this was fiction, the only question for Roe v. Wade was when it would be overturned, not if.
whatever ur opinion on abortion,

Roe v Wade was objectively bad law built upon the weakest case constitutionally

As RBG predicted,

Reason #1: Penumbras,

Roe does not have any actual textual basis in the Constitution, Blackmun based it on "penumbras" meaning he used reasoning on general themes used in the constitution

This means there was never any proof for this newfound right to privacy & abortion
Justice Ruth Bader Ginsburg was a frequent critic of Roe,

she said that it would have been better if Roe had been built upon the equal protection clause of the 14th Amendment, instead of the invisible words found in the penumbras

Ginsburg warned emphatically in a 1992 lecture that Roe's “doctrinal limbs too swiftly shaped, (as) experience teaches, may prove unstable.”

She was right,

Reason #2: Trimesters & Viability

For Roe, even mechanisms, or rules determining legality of regulations are broken beyond repair,

Roe instituted the Trimester rule, where abortion regulations for 1rst trimester are rarely allowed, 2nd sometimes & 3rd almost always prohibited
No basis for this ruling by Blackmun & even @ the time was deemed completely arbitrary,

In 1992 in Planned Parenthood v. Casey, SCOTUS replaced that rule w/ the Viability standard

meaning determining limits on abortion regs based on earliest point a baby can be born & yet live.
A major flaw w/ the Viability standard though, in 1992 viability was 24 weeks, but today that can be as close as 21,

Overtime the ice floe Roe stands upon is melting & thus its mechanisms are falling apart

Remember, Roe came about partially cuz of the lack of options other than abortion for an unwanted child,

But today there are many options on the table, including Plan-B pill & Safe-Haven laws.

Reason #3: Bottomless Pit

Roe & Casey were meant to end the political debate & high tensions on the abortion question.

But these cases made it worse & put SCOTUS on a fatal political trajectory on the issue of abortion

Roe v Wade was always in trouble cuz as a political decision it meant that whenever the political winds changed & popular opinions shifted it meant Roe was going to be in danger of being overturned😲
All the serious people, in law, media, universities, & politicians, have long understood Roe was incredibly fragile.

Only thing protecting it was their incessant threats & Stare De Crisis -meaning the court's hesitancy to overturn historical precedence.

TBF with the media's record I understand why people abhor all journos everywhere, but honestly, there are a lot of us that do really want to do the right thing with our stories & sources

I've screwed up & made mistakes,
but never intentionally & I don't plan to change that
there is a sort of wilful ignorance that's popular right now,

you see it in pieces where they talk about a story but don't link to it

Well that extends to some writers as well, thinking that audiences couldn't handle the full context lest it undermine their argument
