I’ll be in federal court in San Francisco this morning as the ACLU attempts to block the Trump administration’s new asylum policy. Hearing starts in 45 minutes.
Gerlent currently reading over statistics from the early 2000s showing higher number of border arrests then than now, proving that "this is not one of those emergency situations" to institute a change to asylum w/o giving proper time for the public to comment on it.

JUDGE: What is practical effect of the rule?

DOJ: Channel those who seek asylum to POE to be processed and to facilitate negotiations w/ Mexico

JUDGE: Anything in rule that increases % of meritorious applications?

DOJ: Those most likely to have legitimate claims will go to POE
The judge is skeptical.
Judge reads statute says individuals can apply for asylum whether they enter at a POE. “If the rule is valid, what’s left of that Congressional intent?”

DOJ: individuals can be barred from eligibility if they meet certain qualifications.

Judge: None fo them have to do with POE
Judge Tigar asked the DOJ about issues at the POE with processing (delays/metering etc.): "Isn't that inconsistent w/ the stated goal?"

DOJ attorney says that yes there can be delays but that it's early in the process and that more resources may be necessary at the POE.
Judge Tigar asks how the rule will increase likelihood that Mexico will back a third safe-country agreement?

DOJ attorney says that it is a signal to Mexico that they need to work w/ us and they are hopeful that something "fruitful" will be produced between the countries.
Court is in recess now. Back in 10 or so.

DOJ is trying to say that IF the judge does block the asylum policy it should be only for the clients of the organizations in the lawsuit.

Judge says that such an order would make the organizations the most popular law firms at the border. "How's that going to work?"
