UK vows to stay in the European convention on Human Rights as a “basis for cooperation” - something which 2016 Theresa May pondered leaving. Forget that being in next Tory manifesto now.
First substantive point - data protection - EU promises to start adequacy assessment for completion by end transition. V important - Data Commissioner/ Tech industry had been concerned: @rowlsmanthorpe
Quite vague stuff here on regulation: eg UK will consider aligning with Union rules in relevant areas - think that refers to Chemicals, Aviation, medicines, but cant be sure
Reference to facilitation on Ireland border being “considered” in any alternative arrangements. Not sure it was ever not being considered, but no promise to actually do it. Still will DUP/ ERG buy it as progress?
And some referenceto the checks on goods trade being lessened and “taken into account” if there is “alignment of rules” - but no mention anywhere in document of the word “frictionless” - or even “as frictionless as possible”
Zero tariffs of course (unlike WTO) but the “build on the single customs territory” phrase that so irked Dominic Raab but which Number 10 says has been misunderstood is tweaked but still there :
Services - the majority of the economy, and financial services gets a separate mention - have till near end of transition - June 2020 to make assessments on “equivalence” - “transparency and appropriate consultation” on “withdrawal of equivalence decisions” - a big issue here.
Mobility Framework:
Not free movement
UK cannot discriminate within EU - ie what goes for Belgium/ France goes for Bulgaria.
Visa free for short visits.
Transport - On Aviation
Falls short of Mansion House ambition for “associate membership” of EASA, but has “close cooperation” between EASA and CAA.
Comparable market access on road transport
On Civil Nuclear - not staying in Euratom, only associate membership for research and training, but wide-ranging “Nuclear Cooperation Agreement”
On Fishing - access to waters and quota shares with Europe will be settled within the context of overall economic partnership bu July 2020, before we become an independent coastal state
Level playing field for “state aid, competition, social and employment standards, environmental standards, climate change, relevant tax matters, building on arrangements provided for in Withdrawal Agreement” combining “appropriate & relevant [E] Union and international standards”
Dispute Settlement -
On a question of EU Law, arbitration panel should refer question to ECJ as sole arbiter for “a binding ruling”
And they have now hardwired “protecting in all its parts” the Good Friday Agreement into the declaration - which wasnt in the 6 page version
