THREAD (1) I've seen a few questions being posted asking why RAM members aren't being prosecuted in California. The simple answer is that the federal charges involve traveling by interstate commerce (crossing state lines) to commit alleged crimes, namely rioting, in Virginia.
(2) The original four (Daley, Gillen, Miselis, and White) were indicted by a Federal Grand Jury convened in the Western District of Virginia (coincidentally in Charlottesville) on October 10, 2018. The federal charges derive from alleged rioting that occurred at Unite the Right.
(3) The second group of four (Boman, Eason, Laube, and Rundo) were arrested for the same charges under a Criminal Complaint, issued on October 20, 2018, in the Central District of California. As of today they remain un-indicted, but an indictment is likely to be forthcoming.
(4) The activities of the eight (and possibly more) RAM members in California, including alleged assaults committed in both Huntington Beach and Berkeley in 2017, will play a central role as evidence in the federal case.
(5) However, the prosecution does not need to prove each individual assault, but only that the group conspired to use, and used, interstate commerce to incite and participate in rioting at UTR. All eight can still be prosecuted under a number of state laws.
