The latest EU Commission paper on no deal Brexit, with unilateral legislative proposals on some issues, is due soonish. I'll discuss it in a thread starting here. In the meantime, here's my thread on the previous paper & proposals/guidance, from Nov 13th:
2/ Here's today's no deal communication from the Commission: ec.europa.eu/info/sites/inf…
Some comments
3/ Commission repeats its prior position - EU no deal measures are unilateral, limited and temporary. Adds that they will *not* apply to Gibraltar.
4/ On @BritishInEurope Commission says they should get residence permits but doesn't say anything about keeping all acquired rights. Very unimpressive.
5/ Commission plans to issue guidance on social security coordination re @BritishInEurope and @The3Million
6/ Financial services
Commission uses its own secondary law powers to immediately adopt unilateral measures. Experts in the field can hopefully advise on what this does and doesn't cover.
7/ Aviation and road haulage
Commission proposes temporary laws to keep basic services running
Will need to see details of the laws to see what they cover as compared to membership or the withdrawal agreement
8/ Trade in goods
Commission confirms that general rules will apply, ie tariffs and non-tariff barriers. Adopts an immediate change to EU customs law and proposes a law on exports of dual use goods to the UK (civil goods with military uses)
9/ EU climate change policy
Commission immediately adopt three measures to take account of Brexit. One applies from January 2019 already.
10/ Northern Ireland
Proposed legislation to keep border funding programme in force.
Nothing about what happens to the border if no deal
Nothing about impact of no deal Brexit on EU budget
(Nb previous paper said there would be no data protection adequacy decision for the UK)
11/ Here's one of the delegated regulations adopted today - amending EU customs law in light of Brexit: ec.europa.eu/transparency/r…. There's a possibility for EP or Council to block it.
