JUST IN: DOJ formally went to #SCOTUS this afternoon, asking it to bypass the 2nd Circuit and hear the Census citizenship question case. (It previously stated that this would be coming.)

MORE: As expected, DOJ also filed a motion to expedite the Census case, both at the cert stage and, if granted, at the merits stage so that it can be heard and decided this term before the Census forms need to be printed. supremecourt.gov/DocketPDF/18/1…

JUST IN: DOJ asks the judge in the Maryland transgender military ban case, Stone v. Trump, to stay the injunction so "the Department of Defense may begin implementing" the Mattis ban policy. documentcloud.org/documents/5694…
This follows Tuesday's #SCOTUS orders staying injunctions in two other challenges to the Trump administration's policy: buzzfeednews.com/article/chrisg… / The Maryland case injunction, which is as to Trump's initial ban, is the last remaining injunction before DOD can implement the ban.
As @dominicholden noted yesterday, even the lawyers for the challengers to the ban have acknowledged that the trial court in Maryland should at least stay the nationwide injunction in the Maryland case i the wake of the #SCOTUS orders.

On this Independence Day, when we celebrate the U.S. as a democracy and as we await a Scalia-like successor to Justice Kennedy to be nominated for #SCOTUS, some thoughts on how the Court could set the cause of voting rights back significantly in the years to come: /1
The first way that the Court can negatively affect voting rights is by holding that democracy-enhancing laws like the Voting Rights Act or campaign contribution limits are unconstitutional. The second way is by upholding state laws making it harder to register and vote. /2
In the first category, at the top of my list is that #SCOTUS with a fifth hard conservative on race could either hold that Section 2 of the Voting Rights Act is an unconstitutional racial classification or interpret it so weekly it dies death by 1,000 cuts /3

2. So far, there are 6 lawsuits against the #2020census citizenship question, which Commerce Secretary Wilbur Ross (census overseer) approved adding to questionnaire. More than two dozen states & cities, plus other groups & individuals, are trying to get it removed.
3. Lawsuits include:

- State Of NY et al v Commerce Dept et al

- The NY Immigration Coalition et al v Commerce Dept et al

- State of CA v Ross et al

- City Of San Jose et al v. Ross et al

- Kravitz et al v Commerce Dept et al

1. Following up on last week's @WSJ op-ed, Prof. Steve Calabresi has now posted to @SSRN a nine-page "Opinion on the Constitutionality of Robert Mueller's Appointment":

His bottom line: It's unconstitutional.

This #thread explains why he's just wrong:
2. The key to understanding Calabresi's argument is to understand that it is actually two _different_ arguments that need to be addressed separately:

(i) that Mueller's _appointment_ violates the Appointments Clause; and
(
ii) that Mueller's _actions_ violate the Clause.
3. The first of these arguments is a claim that, based on the terms of the office, the Special Counsel is a "principal" officer under the Appointments Clause, and must therefore be nominated by the President, confirmed by the Senate, and removable at will by the President.
