Update: Justice Onnoghen & Tanko Mohammed have 7-working days to respond to petitions against them to the NJC.

NJC referred CCT Chairman’s case to Federal Judicial Service Commision.

Onnoghen was asked to respond to allegations leveled against him, especially why he failed to declare all his assets, as stipulated by law.

Socio-Economic Rights and Accountability Project, (SERAP) has sent an open petition to the Next-In-Rank to the Chairman of the National Judicial Council (NJC) urging the NJC “to immediately take over from the Code of Conduct Tribunal the case of CJN Walter Onnoghen
The NJC should set up a committee to investigate the allegations of breach of constitutional asset declaration requirements against him and ask Justice Onnoghen to step aside from his role as Chief Justice pending the outcome of your investigation into the allegations against him
Also, if following your investigation, the allegations against Justice Onnoghen is established, the NJC should refer the case to appropriate anti-corruption bodies for prosecution.

The suspension of the Chief Justice of Nigeria, Hon. Justice Onnoghen by President Buhari is an action capable of undermining the nation’s judiciary, subverting the Constitution, intimidating judges, and creating uncertainty in the electoral process.
By unilaterally suspending the CJN without following the provisions of the Constitution, President Buhari has sent a dangerous signal to the entire world that Nigeria is no longer a democratic nation and that we have returned to the old, jaded era of military dictatorship.
Our Constitution makes no provision for the suspension of the nation’s highest judicial officer.

1. Hello all. I feel that I need to put in my two bits in the Onoghen CCB debate. First let me tell you where I stand. I am for strong institutions & the rule of law. I believe that the law should be no respecter of persons. With that foundation, please follow me on this journey
2. Facts only:
a) Has the CJN been removed, answer is NO?
b) Can the President remove the CJN, the answer is Yes/No
c) Can the CJN be arraigned before the CCB? The answer to me is inconclusive, but I will be rooting for YESS and I will explain as we go on further.
3. Can the President Remove the CJN?
Yes he can remove the CJN but on the recommendation of the National Judicial Council (NJC) and the NJC itself is advised by the Federal Judicial Service Commission. Please see the following images which are excerpts from the Constitution

The unconscionable and malicious attack on the Judiciary by enemies of our democracy seeking to perfect their rigging bid will fail. No one has been safe under this admin seeking to perpetuate itself in power against the will of the people. The New NIGERIA will surely emerge.
Sections 231 of the Constitution is clear that the President cannot appoint a CJN unless the National Judicial Commission recommends and senate approves. It follows that the CJN cannot also be removed without a similar recommendation.
However Section 231 (4) allows the President to appoint the most senior justice for a maximum of 3 months where “the office is vacant” or “the person is unable to perform the functions of the office”. This is where they are heading.

SERVING JUDGES CAN'T BE TRIED BY CCT.

"By virtue of the judgment of the Court of Appeal in respect of the case of Justice Hyeladzira Nganjiwa, the CJN and in fact, any serving judicial officer judge, cannot be tried by the Code of Conduct tribunal ..
..or even court, until the National Judicial Council, NJC would have dealth with the matter.
Though, the matter is still on appeal at the Supreme court, the judgment still stands.
As a matter of fact, based on that judgment, the Code of Conduct Tribunal had to discontinue the trial of Supreme court justice, Sylvester Ngwuta who was facing trial on alleged false declaration of assets.
