Shall we go through some of the protocols of the withdrawal agreement?

The European Union has produced a handy explainer covering all the main topics

A lot of it is admin stuff which I'm not interested in because I'm shallow and insensitive.
But it starts getting good on page 30

The transition phase will include all current and any new EU laws and obligations, minus voting rights
Okay, so that's a little bit bad. But wait till you see how bad it gets on page 42.

Both sides will use their best endeavours to complete a new trade agreement before the end of the transition phase, but there is no obligation on the European Union to provide it.
If no trade agreement can be completed during the transition, then the transition may be extended, once only.
Otherwise, if there is no trade agreement or extension by January 2021 the backstop will come into force.

So what does the famous backstop say in this final version?
Backstop provisions:

1. UK will align with the customs territory of the EU, but have no say in it.

2. EU will consult with the UK should it wish, but will not defer to it

3. Northern Ireland to remain aligned with the EU and within its legal orbit
4. There will be customs checks on goods moving between Britain and Northern Ireland

5. There will be no unilateral escape mechanism for the UK once the backstop provisions have come into force
So effectively that signs Northern Ireland up to remain in the European Union even after Britain has left, with a border in the Irish Sea that will come into force if Britain wants to leave the customs area.

Ha!
I warned the DUP where the border was going to end up.
Britain stays in the European Union but with no rights or influence in it.
We have no unilateral right to secede from it.
And a new legal border in place, if not in force, between Britain and Northern Ireland.

Because it's all just gob. Parliamentary gob, media gob. Nobody is going to leave the European Union like that. Only the people who will never be prime minister say that
The only people who still think they want to leave Europe are the people with no foresight. If you did that you would plunge into a crisis that you couldn't solve.
And it's not just money. The Irish border does actually need dealing with.
And you've just left the European Union, which means you've just produced a border somewhere, and all you can do now is choose where to put it.
Ireland or the Irish Sea, and in either case the government collapses.

Alright, let's try some more. We start with a planet. The planet is not a car, but all the materials we're going to need to build a car are already present
And although nobody could have built a car 200 years ago, or 200,000 years ago. But all the stuff you needed to build a car was already there. Just not in the right order.
What I mean is, you take all the raw materials that go to build a car, and you start turning them into one.
So at one end you've got was is most definitely not a car, and at the other end you've got a car.
And my question is, when did the car arrive?

For reasons known only to me and my gerbils, I have laid out all the thousands of pieces that go to make up a car.
That's not a care because it's just bits. So at what point in putting it together does it become a car?
Or the other way. Take the door off a car and it's still a car. Take the battery out and it's still a car.
But once it's all in bits there's no car any more, so when exactly in the course of taking it apart does it stop being a car?
I don't think we spend nearly enough time trying to sort out these things.

It is frequently stated that the reason the UK has to sign up to the Backstop in the WA is because the UK is legally bound both through the Belfast Agreement & Dec 2017 EU/UK progress report to prevent any trade friction on the Island of Ireland.
2/I wanted to share some thoughts:
First, lets deal with often quoted argument that the Good Friday Agreement explicitly prohibits any trade friction on the island of Ireland. Here is the Agreement.

3/After reading it I find that there are ZERO mentions of the word friction in the document at all & only 1 use of the word trade - as part of the phrase “Trade Union”.
There are, however, 10 uses of the word border in the document.

As promised, here are my thoughts on the Withdrawal Agreement - this can't possibly be comprehensive on 585 pages of text, plus a short future declaration, but highlighting the main points and how we got to them. Then a verdict - ec.europa.eu/commission/sit… 1/
First, obviously, the backstop. There is to be a UK-wide Customs Union as we know, but Northern Ireland is to be subject to a 90-page list of single market regulations, which the rest of the UK is not. 2/
Now we know that the EU did not want a UK-wide element at all, so this represents something the UK had to push for. In return, the EU has put in place level playing field mechanisms on labour, environment, state aid, but they aren't subject to arbitration 3/

The transition extension clause. A one off extension. But no fixed date is set, apart from it being within this century....
A financial settlement needed to cover transition extension. But Britain won't be treated as a member state -- so it won't be paying and receiving as it does today. It will be outside CAP, for instance, but there are limits set on UK subsidies to farmers.

To leave the EU, we are following the rules laid down in Article 50. A50 is a short, simple document that explains how a country can choose to leave the EU. (The UK was fully involved with producing A50. Indeed, a Brit - Lord Kerr - even drafted it!) 2/47

A couple of noteworthy points:
/1
(1) As expected, Com demands that whole of EU acquis should continue to apply to the UK, incl. all four freedoms, Euroatom, justice and home affairs, even down to the current UK's opt out regime.

This crucially includes primacy of EU law and direct effect
(2) UK will no longer benefit from EU FTAs during transition. This is detrimental to UK economy, but also implies that it may strike its own FTAs during transition.
